Land auctions in Hanoi suburbs are high, while land among the people is plummeting.
After Tet, Hoai Duc real estate, Hanoi - the hot spot for land auctions in August 2024 - was quiet as if the fever had never swept through.
Auction land prices have not increased much but remain high. Meanwhile, local land prices have dropped by tens of millions of VND/m2.
According to Vietnamnet , in Tien Le village, Tien Yen commune, Hoai Duc district, auctioned land with an area of 85m2 to nearly 95m2 is being traded from 95 to more than 110 million VND/m2, about 5-10 million VND/m2 higher than the auction time.
Last year, Hoai Duc district held three land auctions in Tien Yen, the winning price in the first round was up to 133.3 million VND/m2, and the two following rounds were from 91 to 103 million VND/m2.
The survey showed that many investors who won the auction (F0) last August transferred their land immediately after winning with a profit of 300 million VND in difference to investors F1. Since then, almost no F2 investors have bought in. Many F0s still have many unsold lots since winning the auction.
Brokers still expect land prices here to increase, saying that the auctioned land is located in a convenient location for transportation, a few hundred meters from the Ring Road 4 under construction.
In addition, the auction area's amplitude is very large, possibly up to 150 million VND/m2 in the near future.
While the land subject to auction has not increased sharply, the land price in the locality of the people has decreased sharply, currently fluctuating from 55-70 million VND/m2.
A real estate broker said that the price of land in the village has dropped compared to the time when Tien Yen commune organized the auction. At that time, the heat from the auctions pushed the land price here and neighboring villages up to 85-90 million VND/m2, with some plots of 10m wide roads reaching nearly 100 million VND/m2.
Mr. Luong, a resident of Tien Le village, Tien Yen commune, said that when Hoai Duc district organized the auction, the 80m2 plot of land under his name, which was classified as rural residential land, increased in price following the land auctions.
“At that time, the investor offered me 85 million VND/m2 for my land, but I did not sell it. However, recently, someone offered to buy it for less than 70 million VND/m2,” Mr. Luong said.
Ho Chi Minh City proposes to handle the act of leaving land vacant and not using land
Recently, the Department of Natural Resources and Environment of Ho Chi Minh City has sent a document reporting to the Ministry of Natural Resources and Environment on the difficulties and problems in handling the act of leaving land vacant when resolving land use records.
In the document, the Department of Natural Resources and Environment said that in the process of handling land registration and land use extension dossiers, the unit found that there were many cases where land users left land vacant or abandoned. Although these cases still fully performed their financial obligations to the State, they did not perform according to the purpose of land allocation and land lease, causing waste of land resources.
In practice, the Department of Natural Resources and Environment has no basis to handle violations of the law according to Decree 123 regulating administrative violations in the land sector, so there is no basis to recover land according to Clause 1, Article 81 and Clause 2, Article 82 of the 2024 Land Law.
These cases request recognition of land use rights or extension of land use due to the expiration of land use term but not for implementing investment projects, so they are not subject to application according to Clause 8, Article 81 of the 2024 Land Law.
Therefore, to apply uniformly when handling land records, the Department of Natural Resources and Environment recommends that the Ministry of Natural Resources and Environment provide guidance to clarify whether the behavior of land users leaving land vacant, not using land; abandoning land, not exploiting the entire allocated area is considered a land violation or not, is it a basis for land recovery or not, if so, how to handle it under which provisions of the law?
In case of not applying according to current legal regulations, in order to properly implement legal regulations and Resolution No. 98 of the Government on practicing thrift and combating waste, it is necessary to add the regulation "acts causing waste in land management, exploitation and use such as leaving land vacant, unused, abandoned, not fully exploiting the assigned area... to the decree regulating the handling of administrative violations in the land sector.
At the same time, adding the case of land recovery due to violations of land laws according to Article 81 of the 2024 Land Law, applicable to land assigned by the State for management but left vacant, not used continuously for 12 months, and having been administratively sanctioned but continuing to violate.
11 real estate projects in Khanh Hoa will be cleared
The National Assembly has just issued Resolution No. 170/2024/QH15 (effective from April 1) on a special mechanism to remove obstacles for projects and land in the inspection and examination conclusions in Ho Chi Minh City, Da Nang City and Khanh Hoa Province.
Of which, Khanh Hoa province has 11 projects related to land allocation and land lease as stated in the Government Inspectorate's Conclusion in September 2020.
Specifically, the 5 projects in Nha Trang City are: Luna commercial service complex, hotel and tourist apartments and offices for rent; The Horizon Nha Trang hotel; Hoang Phu luxury residential area; Thien Trieu complex and Cat Tiger high-rise, office and hotel project. The above projects were assigned by Khanh Hoa Provincial People's Committee, leasing land without auctioning the right to use.
There are 6 projects that the Khanh Hoa Provincial People's Committee has allocated land for, leased land without bidding, including: The Arena, Cam Ranh Yacht and Resort Club, Evason Ana Mandara Cam Ranh & Spa, Eurowindow Nha Trang high-end eco-tourism and resort area (all part of the Northern Cam Ranh Peninsula Tourist Area), Muong Thanh Nha Trang high-end apartment hotel complex (No. 60 Tran Phu, Nha Trang City).
According to the Resolution recently issued by the National Assembly, investors of the above projects will be allowed to continue implementing them if, after review, they meet the conditions on land use planning, urban planning, and national security and defense. In addition, investors must meet the capacity and conditions to implement the project according to the law.
Khanh Hoa Provincial People's Committee must review the determination of land prices for the above projects, calculate and fully pay financial obligations to the state budget. At the same time, investors must fulfill their financial obligations after re-determining the land prices. In case the project does not meet the conditions after the review, the locality will reclaim the land for management.
In case the project is allocated land or leased land before July 1, 2014, the land price and financial obligations will be calculated according to the price list at the time of issuance of the land allocation or lease decision.
Regulations on urban residential land
Urban residential land belongs to the group of non-agricultural land used for the purpose of building houses and other purposes serving life on the same plot of land in the urban area. So how is urban residential land currently regulated?
Article 196 of the 2024 Land Law (effective from August 2024) stipulates on urban residential land as follows:
1. Urban residential land is land for housing and other purposes serving life on the same plot of land in an urban area.
2. Based on the land fund and actual situation of the locality, the Provincial People's Committee shall prescribe the limit for land allocation to individuals in urban areas.
3. Urban residential land must be arranged synchronously with land used for the purpose of constructing public works and career facilities, ensuring environmental sanitation and urban landscape.
4. The conversion of residential land to land for construction of production and business facilities must comply with the planning, land use plan, and construction plan approved by competent authorities, and comply with the provisions of law on order, safety, environmental protection law, and other relevant provisions of law.
