"Hiding" under another company

According to the conclusion of the Ministry of Public Security's Investigation Police Agency (C03), CDC Bac Giang colluded and legalized with Viet A, Phan Anh Company, price appraisal and bidding consulting companies, in implementing 11 bidding packages for purchasing test kits and other medical supplies and biological products for epidemic prevention and control.

The investigation concluded that from March 2020 to November 2021, Bac Giang CDC advanced test kits from Viet A Company and Phan Anh Company to use for COVID-19 prevention and control.

After that, CDC Bac Giang completed the legal procedures to let Viet A Company and Phan Anh Company win 11 bidding packages "Procurement of materials, chemicals, biological products, and other medical equipment for COVID-19 prevention and control" invested by CDC Bac Giang.

Initially, Viet A Company provided test kits directly to CDC Bac Giang, but in April 2020, Phan Huy Van - Director of Phan Anh Company met with Dang Thanh Minh, Director of CDC Bac Giang, to ask for test kits produced by Viet A Company.

Defendant Van also contacted, discussed and received approval from Viet A Company, signed a document authorizing Phan Anh Company to provide test kits in Bac Giang province.

From here, CDC Bac Giang does not buy directly from Viet A Company but uses test kits produced by Viet A Company through Phan Anh Company.

Therefore, out of 11 bid packages, Viet A Company won 1 bid package with a value of 1 billion VND, and Phan Anh Company won 10 bid packages with a total value of 193 billion VND.

Of which, 7 packages were implemented by open bidding via the Internet with the hiring of a price appraisal unit, 4 packages were implemented by competitive bidding through quotations from suppliers.

In December 2020, after Mr. Dang Thanh Minh retired, defendant Lam Van Tuan was appointed as Director of CDC Bac Giang. Mr. Tuan continued to agree with Phan Huy Van on pre-paying the test kit and legalizing the payment procedure later as in the Dang Thanh Minh period.

Accordingly, CDC Bac Giang will advance the test kit of Phan Anh Company, then through price appraisal units to issue a price appraisal certificate equal to the unit price of the test kit provided by Phan Anh Company (509,250 VND/test kit).

At the same time, to complete the procedures and documents for Viet A Company and Phan Anh Company to win the above packages, CDC Bac Giang hired consulting units to prepare bidding documents and evaluate bidding documents; consult on the appraisal of bidding documents and appraisal of contractor selection results to legalize the documents to submit to departments, branches, and the Provincial People's Committee for approval of bidding and payment.

Around the beginning of May 2021, the COVID-19 epidemic broke out again in Bac Giang province. At this time, there were many units providing test kits at lower prices than Viet A Company.

To avoid competition as happened in Hai Duong, on May 13, 2021, Phan Quoc Viet (Chairman and General Director of Viet A Company) and Vu Dinh Hiep (Deputy Director of Viet A Company) met with Phan Huy Van to discuss the sales policy of Viet A Company.

Defendant Viet said he would only sell to CDC Bac Giang through Phan Anh Company and not directly. The two parties agreed that Viet A Company would pay a percentage outside the contract at a rate of 40% of the contract value if the goods were test kits, and 30% if the goods were received in cash.

Then, Van took Viet and Hiep to CDC Bac Giang to meet Mr. Lam Van Tuan (Director of CDC Bac Giang, replacing Mr. Minh who retired).

At this meeting, Viet said that Viet A Company will perform the technical role of Phan Anh Company, while Phan Anh Company will do the sales. Viet A Company will support CDC Bac Giang in sending technical staff and testing machines to increase testing capacity.

Then, from June 16 to November 25, 2021, the treasurer of Viet A Company used his personal bank account 7 times to transfer more than 44 billion VND in interest outside the contract between Phan Anh Company and Viet A Company to Phan Thi Khanh Van (Van's sister).

After receiving the money, Van asked a relative to put the total amount of 25.19 billion VND in her name to save; a part was put into the fund for Phan Anh Company's business activities.

In addition, according to Ms. Van's testimony, after receiving money from Viet A Company, the defendant went to Mr. Lam Van Tuan's office at CDC Bac Giang twice and gave Mr. Tuan two savings books with a total value of 5 billion VND under the name Phan Thi Khanh Van.

When giving the money, Van always said "Viet A Company thanks you" and "sending you a little gift, when you need to withdraw, call me". When receiving it, Tuan understood that this was money sent by Phan Anh Company about the fact that CDC Bac Giang had borrowed COVID-19 testing supplies and biological products produced by Viet A Company and distributed by Phan Anh Company, then completed the bidding documents, creating conditions for Phan Anh Company to win the bid and provide testing supplies and biological products produced by Viet A Company to CDC Bac Giang.

In early December 2021, when he heard that the Investigation Agency was working with Viet A Company and CDC Hai Duong, Tuan called to make an appointment and returned the two savings books mentioned above to Van.

Lam Van Tuan admitted that the above actions were wrong, did not ensure fairness and transparency in bidding, and violated the prohibitions in the regulations.

On January 21, 2022, the Ministry of Public Security prosecuted Mr. Tuan, Van and Van for violating bidding regulations causing serious consequences.

The two defendants Phan Huy Van and Phan Thi Khanh Van have paid a total of 44 billion VND in compensation.
