On August 23, according to a source from Giao Thong Newspaper, the Chairman of the People's Committee of Ca Mau City (Ca Mau Province) has just issued a decision to enforce and force Mr. HAT (41 years old, residing in Tan Thanh Commune, Ca Mau City) to take remedial measures against him. Mr. T is the owner of the villa considered "the most beautiful in Ca Mau".
The "most beautiful villa in Ca Mau" built by Mr. HAT on aquaculture land will be forcibly evicted and forced to take remedial measures.
Enforced remedy of consequences
According to the People's Committee of Ca Mau city, after the prescribed time of 30 working days from the date of issuance of the decision on administrative sanctions, Mr. HAT did not carry out land procedures, causing difficulties in state management in the locality and undermining people's trust in the government.
To ensure the implementation of Decision No. 82/QD-XPHC dated January 9, 2023 and Decision No. 7309/QD-SDBSHB dated November 15, 2023 of the Chairman of the People's Committee of Ca Mau City on amending and supplementing a part of the decision on administrative sanctions against Mr. HAT, Ca Mau City issued a decision on enforcement. The time limit for implementing remedial measures is 15 days from the date of receipt of the decision.
It is known that, as planned, on the afternoon of August 23, the People's Committee of Ca Mau city organized the implementation of the enforcement decision.
According to the enforcement decision, Mr. HAT must take remedial measures for committing administrative violations as prescribed in Clause 2, Article 11 of Decree No. 91/2019/ND-CP dated November 19, 2019 of the Government regulating sanctions for administrative violations in the field of land.
Specifically, converting aquaculture land to non-agricultural land in rural areas without permission from competent authorities, the violation area is 3,564.8 square meters, the violation location is in Tan Thanh commune, Ca Mau city.
Remedial measures, for the area of 2,261.58m2, apply point a, clause 4, article 11 of Decree No. 91/2019/ND-CP, forcing the restoration of the original state of the land before the violation.
As for the area of 1,303.22m2, apply point a, clause 4, article 11 of Decree No. 91/2019/ND-CP, forcing the restoration of the original state of the land before the violation (according to the current drawing of the land plot established by the People's Committee of Tan Thanh commune).
Within 15 days from the date of receipt of the decision, Mr. HAT must comply with the decision. If after the deadline, Mr. HAT does not voluntarily comply, he will be forced to comply according to the provisions of law.
Mr. HAT has the right to appeal or file an administrative lawsuit against this decision in accordance with the provisions of law.

Was fined 22.5 million VND for administrative violation
Previously, the Facebook account Ho Tap continuously posted images and live streamed the construction process of the building introduced as "the most beautiful in Ca Mau province".
However, upon inspection, this project violated the construction on aquaculture land. Both of these plots of land are not eligible to change the purpose of use from aquaculture land to rural residential land, because they are not in accordance with the construction planning.
On January 9, 2023, the People's Committee of Ca Mau city decided to fine Mr. HAT 22.5 million VND.
At the same time, the authorities also forced Mr. T to remedy the consequences by "restore the land to its original state before the violation".
However, on November 15, 2023, the People's Committee of Ca Mau City decided to amend and supplement part of the above penalty decision. According to this decision, the city amended and supplemented the remedial measures for Mr. T's violating construction.
Specifically, the People's Committee of Ca Mau city forced Mr. T to maintain the current land use status as at the time the violation was discovered (ie the time the villa was built).
Villa owners must carry out land procedures (conversion of land use purpose) according to regulations for an area of more than 2,261m2.
Along with that is restoring the original state of more than 1,303m2 (including the fence).
"The decision to amend and supplement part of the decision on administrative sanctions on January 9, 2023 is in accordance with legal regulations," affirmed the People's Committee of Ca Mau city.
