On August 23rd, according to sources from Giao Thong Newspaper, the Chairman of the People's Committee of Ca Mau City (Ca Mau province) issued a decision to enforce corrective measures against Mr. HAT (41 years old, residing in Tan Thanh commune, Ca Mau city). Mr. T is the owner of the villa considered to be "the most beautiful in Ca Mau".
The villa, described as "the most beautiful in Ca Mau," built by Mr. HAT on aquaculture land, will be subject to forced demolition, and he will be compelled to take remedial measures.
Enforcement to remedy the consequences
According to the People's Committee of Ca Mau City, more than 30 working days have passed since the issuance of the administrative penalty decision, and Mr. HAT has not completed the land-related procedures, causing difficulties in local government management and eroding public trust in the government.
To ensure the enforcement of Decision No. 82/QD-XPHC dated January 9, 2023, and Decision No. 7309/QD-SDBSHB dated November 15, 2023, of the Chairman of the People's Committee of Ca Mau City regarding the amendment and supplementation of part of the decision on administrative sanctions against Mr. HAT, Ca Mau City issues a coercive enforcement decision. The deadline for implementing remedial measures is 15 days from the date of receipt of the decision.
Reportedly, according to the plan, the People's Committee of Ca Mau city will organize the implementation of the enforcement decision on the afternoon of August 23rd.
According to the enforcement decision, Mr. HAT must take remedial measures for having committed an administrative violation as stipulated in Clause 2, Article 11 of Government Decree No. 91/2019/ND-CP dated November 19, 2019, on administrative sanctions in the field of land.
Specifically, the conversion of aquaculture land to non -agricultural land in rural areas was not authorized by the competent authority, with a violated area of 3,564.8m2, located in Tan Thanh commune, Ca Mau city.
The remedial measure for the area of 2,261.58m2, applying point a, clause 4, Article 11 of Decree No. 91/2019/ND-CP, requires restoring the land to its original condition before the violation occurred.
As for the area of 1,303.22m2, applying point a, clause 4, Article 11 of Decree No. 91/2019/ND-CP, it is mandatory to restore the land to its original condition before the violation occurred (according to the land plot survey map prepared by the Tan Thanh Commune People's Committee).
Within 15 days of receiving the decision, Mr. HAT must comply. If he fails to comply voluntarily within the specified timeframe, enforcement measures will be taken in accordance with the law.
Mr. HAT has the right to appeal or initiate administrative litigation against this decision in accordance with the law.

Previously, the Facebook account Ho Tap continuously posted images and live-streamed the construction process of the building, which was introduced as "the most beautiful building in Ca Mau province".
However, upon inspection, this construction project was found to be in violation of building regulations on land designated for aquaculture. Both plots of land do not meet the requirements for conversion from aquaculture land to rural residential land, as they are not in accordance with the construction plan.
On January 9, 2023, the People's Committee of Ca Mau City issued a decision to fine Mr. HAT 22.5 million VND.
At the same time, the authorities also ordered Mr. T to remedy the consequences, "resulting in restoring the land to its original condition before the violation occurred."
However, on November 15, 2023, the People's Committee of Ca Mau City issued a decision to amend and supplement part of the aforementioned penalty decision. According to this decision, the city amended and supplemented the remedial measures for Mr. T's illegal construction.
Specifically, the People's Committee of Ca Mau City ordered Mr. T to maintain the land use status as it was at the time the violation was discovered (i.e., the time the villa was built).
The villa owner must complete the land procedures (conversion of land use purpose) as prescribed for the area exceeding 2,261m2.
In addition, the original condition of over 1,303 square meters (including the fence) will be restored.
"The decision to amend and supplement part of the administrative penalty decision dated January 9, 2023, is in accordance with legal regulations," the People's Committee of Ca Mau City affirmed.
