Adding new forms of medical examination and treatment to the Draft Law on Health Insurance

Kinhtedothi - On the morning of November 15, at the 39th Session, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law amending and supplementing a number of articles of the Law on Health Insurance.

Reporting on the expected reception, explanation and revision of some major contents of the draft Law amending and supplementing a number of articles of the Law on Health Insurance, Chairwoman of the Social Committee Nguyen Thuy Anh said that at the 8th Session, the National Assembly discussed and gave opinions on the draft Law amending and supplementing a number of articles of the Law on Health Insurance.

Based on the opinions of the National Assembly deputies, the agencies have revised the Draft Law in the direction of ensuring clear, substantive, concise, easy-to-understand, easy-to-implement provisions, closely following reality, ensuring feasibility; clearly defining the tasks and powers of agencies, organizations and individuals to improve implementation capacity; simplifying administrative procedures, creating the greatest convenience for people going to see a doctor or get health insurance treatment. The Draft Law only stipulates contents within the authority of the National Assembly; assigning the Government and Ministries to stipulate many contents within their authority to flexibly and promptly amend and supplement when necessary; minimizing the overlapping provisions with provisions in other laws.

Basically, the major contents of the Draft Law have reached consensus among the participating agencies for reception and revision. The Draft Law after revision consists of 03 articles, Article 1 adds 02 new articles regulating late payment and evasion of health insurance payment and amends and supplements 40 articles of the current Law on Health Insurance (including adding 03 new clauses in 2 articles); abolishes Clause 2, Article 32 of Law No. 30/2023/QH15 on forces participating in protecting security and order at the grassroots level, due to the content being included in the draft Law; Article 2 on the effective date; Article 3 on transitional provisions.

Regarding some specific contents, the Chairman of the Social Committee said that, regarding the subjects participating in health insurance, the contribution level and responsibility for paying health insurance, many National Assembly deputies commented on the subjects participating in health insurance, it is expected that Article 12 of the Draft Law will be accepted and revised in the direction of maintaining the subjects stipulated in the current Law; supplementing the subjects stipulated in other Laws; not yet supplementing the Draft Law on relatives of standing militiamen because the Law on Militia and Self-Defense Forces does not stipulate the health insurance regime for this subject but assigns the Government to stipulate other subjects after reporting to the National Assembly Standing Committee, after a period of stable implementation and full assessment, it will be studied and supplemented when comprehensively amending the Law.

At the same time, Article 13 of the draft Law has adjusted the regulations on the contribution level and responsibility for health insurance payment to synchronize with the amendment of health insurance participants. In particular, it stipulates that students continue to participate according to the group of subjects supported by the State budget to ensure stability when participating in health insurance for this group of subjects.

Regarding the provisions on the scope of benefits, benefit levels, initial health insurance medical examination and treatment registration, transfer of health insurance medical examination and treatment facilities, taking into account the opinions of National Assembly deputies and to be consistent with the Law on Medical Examination and Treatment 2023, the Draft Law has supplemented and clarified new forms of medical examination and treatment for which health insurance medical examination and treatment costs are paid, such as: remote medical examination and treatment; family medicine medical examination and treatment; medical examination and treatment at home.

Regarding registration for initial medical examination and treatment, medical examination and treatment according to technical expertise level, the Draft Law is currently being designed in the direction of regulating the rights of health insurance card holders in registering for initial medical examination and treatment at initial and basic medical examination and treatment facilities; outlining the principles of allocating health insurance cards to initial medical examination and treatment registration facilities and assigning the Minister of Health, the Minister of Public Security, and the Minister of National Defense to issue detailed regulations and instructions for implementation in Article 26 based on their authority; regulating the transfer of medical examination and treatment facilities to be carried out according to professional requirements and the ability of the medical examination and treatment facility to meet, and transferring patients to initial medical examination and treatment facilities for treatment and management of chronic diseases in Article 27.

Through discussion, members of the National Assembly Standing Committee assessed that the amendment and supplementation of a number of articles of the Law on Health Insurance has basically met the set goals and viewpoints, gradually institutionalizing the Party's guidelines and policies on health insurance, in sync and consistency with the provisions of the Law on Medical Examination and Treatment and the Law on Social Insurance.

Concluding on this content, Vice Chairwoman of the National Assembly Nguyen Thi Thanh stated that, to ensure feasibility, especially the new contents of the Law, the National Assembly Standing Committee requested the Government to direct relevant agencies to do a good job of information and propaganda work so that all people and medical examination and treatment facilities, medical staff and relevant agencies and organizations clearly understand, fully and accurately implement the provisions of the Law, regularly inspect, supervise and monitor the implementation process to have solutions to handle immediately when necessary...
