Ý Yên - Nam Định: Need to thoroughly handle the case of encroachment on the shared road

Recently, the Natural Resources and Environment Newspaper received a complaint from the family of Mr. Do Van Linh (wife of Nguyen Thi Thanh Thuy) and Mr. Do Thanh Nhan (brother) in Binh Dien village, Yen Loi commune, reporting that Ms. Vu Thi Vui's family had encroached on the common road between households and then built a fence and gardened. According to the petition, the incident took place around 2009, when Ms. Vui's house encroached on the common road, so Mr. Linh's family had to spend money to fill in the bomb crate land (plot number 181/NTS) managed by the People's Committee of Yen Loi commune to make a path.

However, in 2021, when Mr. Linh's family installed an iron gate to lock the path that opened by itself, with the reason that the family had an elderly mother living alone, the family of Ms. Vu Thi Vui and her daughter, Do Thi Thanh Binh, sent an "Urgent Request" to the People's Committee of Yen Loi commune, stating that Mr. Linh's family was occupying the common path of the hamlet.

From the above incident, conflicts arose between the families, leading to arguments and disorder in the area. The Yen Loi commune authorities have invited the two families to reconcile many times, but the matter has not been resolved yet, and people are still sending petitions everywhere to request a resolution.

Ms. Nguyen Thi Thanh Thuy said that realizing that her family's construction of a road on the bomb crate land plot No. 181/NTS managed by the Commune People's Committee was a violation, her family submitted a petition to the Yen Loi Commune People's Committee requesting the return of the above land area and restoration of its original state. At the same time, she requested the Commune People's Committee to redefine the boundary of the common path that Ms. Vui's family had encroached upon. However, up to now, the local government has not redefine the boundary nor has it given a satisfactory answer to the people.

Mr. Tran Dinh Thanh, a civil servant of the commune's land and environment department, said that the incident happened in 2020 when Mr. Linh and Mr. Nhan's families poured concrete piles and built iron gates, and Ms. Vui's family submitted a petition to Yen Loi commune. Mr. Thanh added: "The commune People's Committee sent a notice to the village chief in 2020, but the village chief of Binh Dien did not implement it. Every time Ms. Vui and Ms. Binh went to the commune People's Committee to make a request, these two women asked to do it and resolve it according to their family's wishes. If they did not do it according to their wishes, this family would stand up, talk nonsense, raise their voices, and then leave."

Regarding the above incident, Mr. Tran Xuan Tuan - Chairman of Yen Loi Commune People's Committee said that according to the cadastral map, Ms. Vu Thi Vui's family is currently violating, encroaching on the common road area, and also encroaching on the bomb barrel land (plot 181/NTS) managed by the Commune People's Committee. However, up to now, the locality has not yet determined the boundary, so they are handling each issue one by one. First, the gate of Mr. Nhan's family is dismantled, then assigned to the cadastral officer to re-determine the boundary of adjacent households for handling according to regulations.

In response to the above incident, it is recommended that the authorities of Ý Yên district and Yên Lợi commune intervene to inspect, redefine boundaries, redefine common paths between households, and handle households that are violating public land in accordance with the provisions of law.
