In the journey towards the new era - the era of civilization and modernity, streamlining the apparatus and building a strong, effective and efficient political system is a great revolution, in which ensuring the rights of civil servants and attracting and using talents are among the key issues.


Decrees: 177/2024/ND-CP, 178/2024/ND-CP, Decree 179/2024/ND-CP on policies for cadres who quit their jobs; policies for cadres, civil servants and public employees affected by streamlining the apparatus and policies to attract and promote talents are expected to create a breakthrough to ensure the rights of cadres and civil servants, contributing to building a strong political system.

Creating alignment between policy and practice

At the National Conference to disseminate and implement the summary of Resolution No. 18-NQ/TW on continuing to innovate and reorganize the apparatus of the political system to be streamlined and operate effectively and efficiently, the Party Central Committee continued to emphasize the general goal of streamlining the apparatus of the political system, reducing staffing associated with restructuring, improving the quality, effectively using the team of cadres, civil servants, and public employees, reducing regular expenditures, contributing to reforming salary policies.

Institutionalizing the Party's policy, the Government successively issued the following Decrees: Decree No. 177/2024/ND-CP (Decree 177) dated December 31, 2024, stipulating the regime and policies for cases of non-re-election, re-appointment and cadres who resign or retire at will; Decree No. 178/2024/ND-CP (Decree 178) dated December 31, 2024, on the regime and policies for cadres, civil servants, public employees, workers and armed forces in implementing the reorganization of the political system; Decree No. 179/2024/ND-CP (Decree 179) dated December 31, 2024 stipulates policies to attract and employ talented people to work in agencies, organizations and units of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front and socio-political organizations.

The fact that the Decrees take effect from January 1, 2025 shows the synchronization between policy and practice and the careful preparation of the Government, ensuring that the major groups of policies introduced are not just formalities, but can be effectively implemented immediately.

The objective of Decree 177 is to promptly institutionalize the Party's guidelines and policies on implementing regimes and policies for cadres after Party Congresses at all levels and cadres under the management of the Politburo and the Secretariat who are allowed to retire or retire by competent authorities according to Conclusion Notice No. 20-TB/KL dated September 8, 2022 of the Politburo. In addition, it is necessary to develop appropriate policies to encourage and recognize the work and contributions of cadres who are not old enough to be re-elected and wish to retire; to resolve difficulties and inadequacies in the process of organizing and implementing policies, contributing to improving the effectiveness and efficiency of cadre management.

According to Decree 177, there are three groups of beneficiaries of the regime and policies, including:

(i) Cases where officials are not old enough to be re-elected (less than 30 months from the time of the congress to the time of retirement).

(ii) In cases where the working time from the date of the Congress is from 30 to 60 months, they are of retirement age, but due to the arrangement of Party committee personnel, they wish to retire and are approved by the competent authority.

(iii) Cadres under the management of the Politburo and Secretariat are allowed to retire or retire by competent authorities according to Conclusion Notice No. 20-TB/KL dated September 8, 2022 of the Politburo.

The above contents create a legal basis for resolving cases where the Politburo and Secretariat manage violations and are dismissed or retired early by competent authorities; supplementing regulations allowing the application of the regime to cases where disciplinary action is not taken but who wish to resign or retire early.

In addition, Decree 177 abolishes the policy of continuing to work until reaching retirement age; to address practical requirements for those who are not old enough to be re-elected but still choose to stay on the job, making it difficult to arrange and assign work positions; thereby encouraging the enjoyment of the regime to quit work and retire immediately.

In the context of administrative reform and state apparatus restructuring, the implementation of policies for workers, especially cadres, civil servants and public employees retiring before the age limit, has become a very important issue and is of interest to many people.

Accordingly, Decree No. 178 demonstrates the Government's determination and determination in implementing the goal of streamlining the organization and apparatus of the political system. With 3 chapters and 27 articles, Decree 178 sets out a number of policy groups such as: Policy for people retiring early, receiving a one-time pension for the early retirement period; enjoying the policy of retiring early, receiving pension and not having the pension rate deducted, receiving pension for early retirement, rewards for early retirement (Article 7); policy of resignation for officials and civil servants (Article 9); policy of resignation for public employees and workers (Article 10)...

In addition, Decree 178 also clearly states the policy on training and improving the qualifications of cadres and civil servants after reorganization; policies and regimes for subjects belonging to the armed forces during the process of reorganization of the apparatus as for cadres, civil servants, public employees and contract workers in state agencies.

Thus, it can be seen that for a cadre who retires before the age, he/she will still receive full salary according to the salary scale, will not have the pension rate deducted due to early retirement and will still receive allowances such as: leadership position, public service, party work, mass organizations...

These regulations practically contribute to ensuring the rights of cadres, civil servants and public employees who resign due to organizational restructuring. At the same time, they aim to retain and promote cadres with outstanding qualities and abilities; increase the number of cadres, civil servants and public employees at the central and provincial levels who go on business trips to the grassroots to increase human resources and create momentum for local socio-economic development.

Attracting talent to the public sector

Decree No. 179 clearly demonstrates the Party and State's viewpoint on attracting and employing talented people in agencies, organizations, and units of the Party, State, the Vietnam Fatherland Front, and socio-political organizations.

According to this Decree, ministries, branches, central and local agencies must prioritize staffing to recruit excellent graduates and talented young scientists. The head of the agency managing civil servants and public employees is responsible for determining specific job positions that require talented people at the agency, organization, or unit under their management.

The Decree focuses on three specific groups of subjects: (i) the group of talented cadres, civil servants and public employees - this is the group of existing personnel in the public sector, with expectations determined based on outstanding capacity and ability to effectively contribute to state management activities; (ii) the group of excellent graduates and talented young scientists - this group is easily identified through outstanding academic achievements or published scientific works; (iii) the group of experts, managers, business administrators, leading scientists - this group includes both Vietnamese and foreigners, based on experience and achievements in the field of expertise.

To attract and promote the above groups of people, Decree 179 sets out 6 outstanding policies: priority in recruiting talented people who will be facilitated to participate in special, shortened and prioritized recruitment processes compared to the normal process; regulations on special financial subsidies when they join the public sector; after recruitment, talented people will participate in intensive training and development programs to maximize their capacity; there are preferential policies in arrangement and use after recruitment; after recruitment, talented people will be prioritized to be assigned to positions suitable to their expertise, experience, and personal strengths, helping them maximize their capacity.

For those with talent and management ability, the Decree opens up opportunities to be considered and appointed to leadership or management positions when qualified. Support policies for experts, managers, business administrators, leading scientists who are Vietnamese overseas or foreigners - simplifying visa procedures, work permits and long-term residence permits, creating favorable conditions for long-term settlement, outstanding contributions of individuals are honored and recognized at national events.

Decree 179 also clearly states that excellent graduates and talented young scientists, when recruited as civil servants or public employees, will receive 100% of their salary during their probationary period. At the same time, they will receive an additional allowance equal to 150% of their current salary coefficient within 5 years from the date of the recruitment decision.

For experts, managers, business administrators, and leading scientists who are Vietnamese, of working age according to the provisions of the law on labor, if they wish to work long-term at agencies, organizations, and units in the political system, the competent authority will consider accepting them into the civil service and public employees and will receive an additional allowance equal to 300% of the current salary (including: salary according to rank, position, title, professional title and salary allowances according to the provisions of law).

Based on the needs and tasks of the agency, unit and the capacity of experts, managers, business administrators and leading scientists who are Vietnamese, competent authorities may consider and appoint experts, managers, business administrators and leading scientists who are Vietnamese to hold leadership and management positions or positions or arrange them to job positions with professional and technical requirements of the main expert, senior expert and equivalent positions; appoint them to the professional positions and titles corresponding to the arranged job positions.

For the policies outlined in the three Decrees to be truly effective, there needs to be a transparent monitoring and evaluation mechanism, early detection of problems, and timely adjustment measures. Supportive policies, such as job transfers, retraining, or retirement, need to be implemented in a uniform and fair manner, creating trust and motivation during the transition process.

In addition, it is necessary to develop detailed action plans to help concretize each group of policies and ensure feasibility when put into practice. At the same time, communication work needs to be promoted so that all relevant subjects, from cadres, civil servants, public employees to armed forces, clearly understand the objectives, content and meaning of the Decree.

Above all, close coordination between all levels and sectors, from the central to local levels, will be a prerequisite to ensure consistency and effectiveness in implementing the Decree, contributing to improving the operational efficiency of the political system, meeting the country's sustainable development expectations.
