Also participating in the survey were representatives of leaders of specialized agencies under the Department of Industry and Trade, Department of Construction, Inspectorate, Provincial People's Procuracy, Provincial Civil Judgment Enforcement Department; representatives of leaders of Nui Thanh District People's Committee; specialized departments and offices of the district and leaders of Tam Xuan 2 Commune People's Committee.
Previously, at the regular citizen reception in August 2024 of the Provincial National Assembly Delegation, citizen Huynh Thi Xuan Vien (Vinh An Nam village, Tam Xuan 2 commune, Nui Thanh) reflected her disagreement with the verdict "Dispute over land use rights and forced demolition of constructions on land" of the People's Court (TAND) of Nui Thanh district.
Taking note of the content that Ms. Huynh Thi Xuan Vien reflected at the meeting, National Assembly delegate Phan Thai Binh - Permanent Vice Chairman of the Provincial People's Committee assigned the Office of the National Assembly Delegation & Provincial People's Council to preside over and coordinate with relevant agencies and units to conduct a survey of the actual housing of Ms. Huynh Thi Xuan Vien's household to have a basis for reporting and making specific proposals.
At the same time, Ms. Vien was requested to submit a petition to re-present the entire case, including recommendations such as: the court sent the verdict late, the content of the verdict forcing her to return 7.2m2 was unreasonable, sent to the Chief Justice of the Provincial People's Court. At the same time, the Chief Justice of the Provincial People's Court was requested to consider and resolve her recommendations.
It is known that in Judgment No. 01 dated January 17, 2023 of the People's Court of Nui Thanh district, the law has come into effect: Partially accepting the lawsuit request of the plaintiff Ms. Huynh Thi Xuan Vien regarding "Forcing the demolition of constructions and architectural objects built on the land, returning the encroached land area" against the plaintiff Mr. Nguyen Tan Phuong (living next door). Forcing Mr. Nguyen Tan Phuong to dismantle and cut off the overlapping construction gutter and gutter of Ms. Vien's house (with specific area, attached current status drawing).
The Court acknowledged that the disputed area of 11.2 square meters located between plot number 608 and plot number 8, map sheet number 26 (file 64/CP) in An Dong village (now Vinh An Nam village, Tam Xuan 2 commune) is under the legal management and use of Ms. Huynh Thi Xuan Vien.
However, the above Judgment No. 01 dated January 17, 2023 of the People's Court of Nui Thanh District declared the area of 7.2m2 (the land on which Mr. Phuong built structures) located between plot No. 608 and plot No. 8, map sheet No. 26 (file 64/CP). Mr. Nguyen Tan Phuong is obliged to return to Ms. Huynh Thi Xuan Vien the land use value for the above 7.2m2 with an amount of more than 2.3 million VND.
