The Government proposed that protection zone I of the relic be used for investment projects and the construction of individual houses, but many members of the National Assembly Standing Committee disagreed.
The Government's proposal is stated in the draft revised Law on Cultural Heritage, which was commented on by the National Assembly Standing Committee on April 17. Protection zone I is the area containing the original elements constituting the relic, including works and locations typical of historical and cultural events or associated with the life and career of national heroes, celebrities and historical figures.
Representative of the inspection agency, Chairman of the Culture and Education Committee Nguyen Dac Vinh said the draft regulation stipulates that protected area I must keep the original state of the site in terms of ground and space. Therefore, to ensure this principle, the Committee does not agree with the proposal to allow the construction of individual houses in protected area I.
"Construction and renovation of houses should only be allowed in cases where heritage sites already have residents, such as Duong Lam ancient village, Hoi An ancient town, and the Complex of Hue Monuments. Construction must ensure the principles of management, protection, and promotion of heritage values and the original elements that make up the monument," said Mr. Vinh.
Chairman of the Economic Committee Vu Hong Thanh also disagreed with building individual houses in the core area of the relic. "Previously, when I was working in Quang Ninh, the province had to spend hundreds of billions of VND to move the floating houses on Ha Long Bay out of the core area. Now the law allows building individual houses in the core area, which is not good," said Mr. Thanh.
He suggested that the drafting agency should only regulate housing construction in Zone II (buffer zone) so as not to hinder the socio-economic development of localities with large heritage protection areas such as Ha Long City, Thua Thien Hue, and Ninh Binh.

Need special policies to preserve heritage
National Assembly Chairman Vuong Dinh Hue said that cultural heritage must be considered a resource for development. Currently, heritage in some localities has not been fully exploited while state resources can only meet a part of the demand. If other sectors participate in investing according to the state's direction, the relics will be promoted and preserved.
According to him, in the policy and strategy for developing the cultural industry and market, digital transformation of culture and digitalization of heritage must be emphasized. The drafting agency needs to design more policies to diversify resources for conservation and development; design into policies public-private cooperation in cultural development.
The National Assembly Chairman requested the Ministry of Culture, Sports and Tourism to study some specific policies for preserving and promoting the heritage and cultural values of ethnic minorities in mountainous and island areas, and rare cultural heritages that are at risk of being lost. "The draft has mentioned languages and writings, but there are still some heritages that need specific policies, especially for ethnic minorities in mountainous and island areas, and ethnic minorities with very few people," said Mr. Hue.

Explaining, Minister of Culture, Sports and Tourism Nguyen Van Hung said that the Ministry really wants to attract more resources, but the cultural heritage sector is very specific, and public-private partnership (PPP) is not qualified in many cases. For example, projects from 100 billion VND can only be implemented under the PPP form, but cultural projects worth 100 billion VND are "very difficult to approve". He proposed amending the Investment Law in the form of public-private partnership to create more mechanisms and resources as suggested by the National Assembly Chairman.
Mr. Hung explained the proposal to add regulations on construction in protected area I to "promote the value of heritage". To build individual houses, investors must comply with the provisions of the Law on Cultural Heritage, the Law on Construction and ensure uniformity in height, number of floors, architecture and must have the opinion of specialized agencies. This content will be thoroughly decentralized to the locality, the Department of Culture will advise the Provincial People's Committee to grant permits, without having to ask for the opinion of the Ministry.
The draft Law on Cultural Heritage (amended) will be submitted to the National Assembly for comments at the May session. The draft adds new regulations on the transfer of relics, antiquities, and national treasures; adds conditions for establishing public museums and licensing the operation of non-public museums.
