Recently, the Ministry of Labor, Invalids and Social Affairs issued Circular 05/2023/TT-BLDTBXH stipulating the list of arduous, toxic and dangerous occupations at intermediate and college levels. With this list, dozens of occupations at intermediate and college levels in the performing arts group were "named" for the first time.
Vocal music profession at both intermediate and college levels is classified as a heavy, dangerous, and toxic profession.
Circular 05 is applied to courses of enrollment and training organization from July 30, the date the circular takes effect.
Circular 05 was issued to replace Circular No. 36/2017/TT-BLDTBXH (effective from December 29, 2017). The implementation of regulations in vocational education for students of arduous, toxic, dangerous occupations at intermediate and college levels, courses enrolled and organized before the effective date of Circular 05, shall continue to comply with the provisions of Circular 36 until the end of the course.
It is known that Circular 36 promulgates a list of arduous, toxic, and dangerous occupations at intermediate and college levels with 117 occupations at intermediate level and 84 occupations at college level. After 5 years of implementing Circular 36, many opinions suggest that it is necessary to update and supplement the list of arduous, toxic, and dangerous occupations to suit the actual conditions in current production and business activities.
In 2020, the Ministry of Labor, Invalids and Social Affairs also issued Circular No. 11 promulgating the list of arduous, toxic, dangerous occupations and jobs and especially arduous, toxic, dangerous occupations and jobs to replace previously issued documents. Circular 11 has added many fields, occupations and jobs of arduous, toxic, dangerous and especially arduous, toxic, dangerous nature related to the fields and occupations studied in vocational education.
Therefore, Circular 05 has also updated and supplemented arduous, toxic, and dangerous occupations at intermediate and college levels, in accordance with the content of Circular 11. Compared to Circular 36, Circular 05 has added 86 intermediate-level occupations and 62 college-level occupations and vocations.
Notably, among the added occupations, there are 20 intermediate-level occupations and 9 college-level occupations in the performing arts group. According to Circular 36, there are no occupations in the performing arts group.
20 intermediate-level occupations and professions in the performing arts group include (in parentheses are occupations and professions that are also classified as arduous, toxic, and dangerous at college level): folk song performing occupations (including college level), cheo, tuong, cai luong, dance drama, ethnic folk dance, circus (including college level), quan ho folk songs, spoken drama; traditional musical instruments (including college level), Western musical instruments (including college level), Southern amateur music and music; folk theater musicians, Hue traditional musicians, organists, vocalists (including college level), choir conductors; drama and film actors (including college level), theater and dance stages (including college level).
According to Dr. Truong Anh Dung, Director General of the General Department of Vocational Education, Ministry of Labor, Invalids and Social Affairs, the issuance of Circular 05 is the basis for learners and teachers in vocational education institutions to enjoy state support policies when studying and teaching arduous, toxic and dangerous occupations and professions according to the provisions of law, thereby attracting learners to study these occupations, contributing to reducing the inadequacy in the structure of training occupations and professions.
The principle of determining which majors and occupations are arduous, toxic, and dangerous is that the time for practice and internship in the training program related to arduous, toxic, and dangerous work, and especially arduous, toxic, and dangerous work, accounts for more than 50% of the total training program duration of that major or occupation.
