TIRED OF WAITING FOR THE PINK BOOK

Talking to us, many households who bought apartments at Thai An 3 and Thai An 4 apartment buildings (Go Vap District) of Dat Lanh Company said that they bought their houses 10 years ago but have not yet received their pink books. Ms. D.L, a homeowner here, said that nearly 800 households in these two apartment blocks are constantly fighting with the investor to demand their pink books but all in vain. Not only do they not have pink books, they also have to face many other disputes such as: maintenance fund, joint and separate ownership, establishment of management board... Living for decades in a house without a pink book makes home buyers no different from renting.

"Most of the home buyers here are poor workers, they save their whole lives to buy a house, so everyone is worried and anxious to get a pink book for peace of mind. Houses without a pink book have a reduced value, and now banks no longer lend money. After many years of unsuccessfully demanding a pink book, we no longer expect or hope for anything because we heard that the company has dissolved, the money is probably gone and this investor is no longer doing any projects," Ms. D.L said indignantly.

In the same situation, residents living in Lexington apartment building (Thu Duc City) have also been waiting for their pink books for decades. In early 2021, the Department of Natural Resources and Environment (TN-MT) issued a document that met the conditions for issuing pink books, and people eagerly completed the application. But by the end of 2021, the Land Management Office replied that it had not been possible because the investor had not fulfilled its financial obligations. The government said so, but the investor, Novaland Company, insisted that it was eager to pay additional land use fees as required by the state to proceed with issuing pink books for customers. The company was even willing to pay in advance but had not yet received approval from the authorities. Ms. Ho Thi Vinh, representative of Lexington residents, expressed that when buying an apartment, customers had paid in full and they wanted to know what problems were still there, where they were, and how to resolve them to issue pink books to people.

An apartment building in District 4 has been inhabited for many years but residents have not received their pink books.

At Hung Ngan Garden apartment building (District 12) or Saigon Home project (Binh Tan District), the situation of households is similar. They bought houses a decade ago but have not yet received the pink book. According to the instructions from the Department of Natural Resources and Environment and the People's Committee of Binh Tan District, Saigon House Company is responsible for contributing funds, coordinating with the People's Committee of Binh Tan District to complete compensation for the area of ​​161.66 m2 (the area outside the planned road boundary) that has not been compensated according to the certificate of land use rights, house ownership rights and other assets attached to the land. Although the amount is quite small, the "saw-and-waited" for many years has made it impossible to complete the documents to proceed with making pink books for customers.

Mr. Bui Ngoc Minh, Director of Minh Thanh Company - investor of Minh Thanh apartment building (District 7), is tired because for many years the company has been patiently going through the procedures to issue pink books to people, but it has not been completed because it is stuck in the stage of determining residential land and commercial land. Although the Ho Chi Minh City People's Committee has directed the departments to hold meetings many times, there has been no result.

WILL ALL BE GRANTED IN 2023?

In response to public concerns, Mr. Nguyen Toan Thang, Director of the Department of Natural Resources and Environment of Ho Chi Minh City, said that the number of applications for pink books has increased every year. In the past 8 years, the Department has processed pink books for 107,195 applications, and is currently processing 58,521 applications, but tens of thousands of apartments have not been issued because investors mortgaged the project's pink books at banks but did not complete the mortgage cancellation registration procedure. Therefore, there is no basis to consider and evaluate the conditions for granting pink books to home buyers at 60 projects.

The next reason is that the investor did not construct according to the permit or planning, so he was not qualified to accept the project, complete the work, and issue the pink book. In addition, before issuing the pink book to the home buyer, the investor must fulfill the additional financial obligations for the project according to the provisions of Decree 148 of the Government. Meanwhile, the additional financial obligations arise due to changes in planning and construction indicators during the project implementation process, or according to the content of the inspection and examination conclusion, the financial obligations must be reviewed...

There are currently 39 projects with 26,959 apartments facing this problem. Another reason is that the inspection, examination and auditing agencies have requested to provide documents and temporarily suspend the settlement of administrative procedures on land; according to statistics, there are 18 projects, with a total of 9,413 apartments. Finally, it is due to the provisions of the law on new types of real estate. In fact, there are many projects including many types of construction items, including construction items designed and licensed for mixed-use purposes such as residential apartments (apartments for rent) or offices combined with residential apartments (officetel, condotel, shophouse) ...

To issue pink books for these houses, the Department of Natural Resources and Environment has issued a specific plan and reported to the leaders of the City People's Committee to direct relevant departments and branches to coordinate in resolving the issue. Accordingly, it has classified a number of groups of projects that are facing difficulties and proposed solutions and roadmaps to resolve them.

For 47 projects that are only waiting for confirmation of completion of financial obligations (group 1), work with tax authorities and enterprises to urge the fulfillment of financial obligations, and resolve in June. Issue pink books immediately after receiving notice of completion of financial obligations from the tax authorities. For 30,061 apartments where enterprises are late in submitting applications for pink books (group 2), the Department of Natural Resources and Environment will work with enterprises to urge the submission of applications. For 29 projects with 10,019 apartments with problems related to new types of real estate that are not yet regulated in legal documents (group 3), the Department of Natural Resources and Environment will organize a training session with the participation of the Ministry of Natural Resources and Environment. Strive to complete the issuance of pink books for the remaining number of apartments in groups 2 and 3 by the end of the third quarter of 2023.

For 39 projects that must fulfill additional financial obligations (group 4), 23 projects are being appraised by consulting units. After receiving the appraisal certificate from the consulting unit, they will be submitted to the City Land Valuation Council for consideration and appraisal. For the remaining 16 projects, the Department of Natural Resources and Environment will coordinate with the Department of Finance in the process of synthesizing and submitting to the City Land Valuation Council for consideration and appraisal of land price plans. Implementation time is from the second quarter to the fourth quarter of 2023. For the other 6 stuck projects (group 5), the Department of Natural Resources and Environment will study and propose solutions to competent authorities. In cases beyond the authority, it will be reported to competent authorities for consideration and resolution. Implementation time from quarter 2 to quarter 3. With 18 projects, 8,235 apartments under inspection, examination, investigation (group 6), there will be a written exchange with the inspection, examination, investigation agency about the possibility of continuing to carry out procedures for granting pink books for each specific project; Implementation time from quarter 2 to quarter 3.

We are aware of our responsibility in this matter to remove difficulties and obstacles for businesses, speed up the issuance of pink books for projects, as well as protect the legitimate rights and interests of home buyers. On that basis, the Department of Natural Resources and Environment clearly and specifically assigns tasks to speed up the issuance of pink books to people.
