Continue to promote administrative procedure reform more strongly and drastically, improving the business environment substantially and effectively.
The document stated that, implementing the direction of the Government and the Prime Minister, in recent times, ministries, branches and localities have made efforts to reform administrative procedures associated with national digital transformation to reduce administrative procedures and regulations, compliance costs, improve the quality of public service provision for people and businesses, thereby gradually removing difficulties and obstacles for investment, production, business activities and people's lives.
Since the beginning of 2021, ministries have cut and simplified more than 2,200 business regulations in 177 legal documents; the Prime Minister has approved a plan to cut and simplify more than 1,100 regulations related to business activities; provided more than 4,400 online public services on the National Public Service Portal, etc. Accordingly, by May 2023, the total number of administrative procedures nationwide was 6,422, a decrease of 376 administrative procedures compared to the same period in 2020.
However, according to the assessment of National Assembly deputies through discussions in the hall on socio-economics, listening to the opinions of the people and the business community, administrative procedures in some areas are still barriers to production, business activities and people's lives; internal administrative procedures have not been reviewed and reduced; the settlement of administrative procedures still goes through many intermediate levels, causing delays and congestion in implementation; the work of publicizing and making transparent administrative procedures and providing quality online public services is still limited; the organization of administrative procedures in some places is not strict, there are still phenomena of harassment, negativity, and additional procedures outside of regulations, increasing time, social costs, and reducing management effectiveness.
To continue to promote administrative procedure reform more strongly and drastically, and improve the business environment substantially and effectively, the Prime Minister requests:
1. Ministers, Heads of ministerial-level agencies, Chairmen of People's Committees of provinces and centrally-run cities urgently and seriously implement:
a) Focus on reviewing, cutting and simplifying regulations and administrative procedures related to investment, production, business activities and people's lives, ensuring the reduction and simplification of at least 20% of regulations and the reduction of at least 20% of compliance costs according to the Government's direction in Resolution No. 68/NQ-CP dated May 12, 2020, Resolution No. 76/NQ-CP dated July 15, 2021 and Resolution No. 131/NQ-CP dated October 6, 2022, including studying and proposing to immediately cut unnecessary procedures and intermediate steps; overlapping and unquantifiable business conditions to ensure transparency in inspection, appraisal, assessment and approval; overlapping specialized inspection activities with the participation of many agencies and units; At the same time, research and propose solutions to socialize qualified public administrative services. Complete and submit to the Prime Minister for approval the plan to reduce and simplify before September 30, 2023.
b) Strictly assess the impact, give opinions, appraise and examine administrative procedure regulations in proposals, projects and draft legal documents, in which resolutely issue new administrative procedures only when really necessary to manage and adjust newly arising social relations.
c) Strengthen decentralization, authorization, and resource allocation in administrative procedure implementation; restructure processes, provide online public services in a user-centered manner, avoiding formalities, movements, insubstantiality, and inefficiency.
d) Urgently carry out statistics, review, cut and simplify at least 20% of internal administrative procedures to improve the effectiveness and efficiency of the state administrative apparatus according to the Plan issued with Decision No. 1085/QD-TTg dated September 15, 2022 of the Prime Minister.
d) Implement public, transparent, complete, accurate and timely information on administrative procedures and the process of receiving and handling administrative procedures so that people and businesses can access, monitor, supervise and evaluate the process of organizing the implementation of administrative procedures. Ministries, branches and localities shall review, publish, update and fully publicize the components of administrative procedures on the National Database on Administrative Procedures in accordance with the provisions of Article 8 of Decree No. 63/2010/ND-CP dated June 8, 2010 of the Government (as amended and supplemented), to be completed in September 2023.
e) Conduct assessment of service quality for people and businesses in handling administrative procedures and providing public services based on real-time data as prescribed in Decision No. 766/QD-TTg dated June 23, 2022 of the Prime Minister; improve service quality and satisfaction level, including strengthening discipline and administrative discipline, regularly inspecting, strictly handling and announcing and publicizing cadres, civil servants, public employees, agencies and units that cause delays, inconvenience, especially creating additional procedures, records, documents, and requirements that are not in accordance with regulations in the process of receiving and handling administrative procedures.
g) Strengthen accountability, effectively receive and handle feedback and recommendations on administrative regulations to promptly resolve difficulties, problems and inadequacies for people and businesses. End the situation of shirking responsibility, not handling or prolonging the handling time.
2. The Ministry of Planning and Investment shall preside over and coordinate with ministries, branches, localities and relevant agencies to implement solutions to improve the business environment and enhance national competitiveness according to the Government's direction in Resolution No. 01/NQ-CP dated January 6, 2023; review and submit to the Prime Minister plans to reduce and simplify regulations and administrative procedures related to the implementation of investment projects and public investment, to be completed in September 2023.
3. The Ministry of Justice and legal organizations of ministries, branches and localities shall take the lead in further strengthening the appraisal of administrative procedure regulations in proposals, projects and draft legal documents to ensure that only administrative procedures that have been assessed for impact and are truly necessary, reasonable, legal and effective are promulgated. Strictly control administrative procedure regulations in legal documents under the promulgation authority of Ministers, Heads of ministerial-level agencies and People's Councils and People's Committees at all levels.
4. The Ministry of Home Affairs shall preside over the inspection, guidance and urging of ministries, branches and localities to promote decentralization and delegation of power along with resource allocation, and strengthen supervision and inspection in state management between the Government, the Prime Minister, ministries, branches and local authorities according to the direction of the Government in Resolution No. 04/NQ-CP dated January 10, 2022.
5. The Government Office assists the Prime Minister in urging, guiding and inspecting ministries, branches and localities to effectively implement the direction of the Government and the Prime Minister on this work; periodically summarize the implementation results and report to the Prime Minister every quarter. Promote the role of the Standing Committee of the Prime Minister's Advisory Council on Administrative Procedure Reform in dialogue, grasp the difficulties and problems of enterprises and people to proactively and promptly report and propose solutions to the Government and the Prime Minister./.
