Kinhtedothi-The Ministry of Home Affairs has proposed that from March 5, agencies, organizations, and units temporarily not implement policies and regimes for commune- and district-level officials and civil servants within the scope of Decree 177/2024.
The Ministry of Home Affairs has just issued an official dispatch to provincial and municipal Party Committees and People's Committees on the regime and policies for cadres and civil servants who are not re-elected or re-appointed at Party congresses at all levels.
According to the Ministry of Home Affairs, implementing Directive No. 35/2024 of the Politburo dated June 14, 2024 on organizing Party congresses at all levels, towards the 14th National Party Congress, the Government issued Decree 177/2024 stipulating the regime and policies for cadres who are not re-elected, not re-appointed, and cadres who quit their jobs or retire at will.
However, on February 28, the Politburo and the Secretariat issued Conclusion No. 127 on the implementation of research and proposals to continue to reorganize the apparatus of the political system. In which, there is a provision "Temporarily suspend the organization of Party congresses at the commune and district levels; after the 11th Conference of the Party Central Committee, the Politburo will have specific instructions and guidance".
On that basis, along with the request of a number of localities, the Ministry of Home Affairs proposed that from March 5, agencies, organizations and units temporarily not implement the settlement of regimes and policies for commune-level and district-level cadres and civil servants within the scope of Decree 177/2024.
For cases that have been decided by competent authorities to enjoy the regime and policies according to Decree 177 before March 5, these benefits will remain unchanged.
The Ministry of Home Affairs requests that provincial and municipal Party Committees and People's Committees of centrally-run provinces and cities direct their affiliated agencies, organizations and units to strictly implement the instructions.
Decree 177/2024 divides the subjects into 3 groups: Group 1 is not eligible for re-election (less than 30 months until retirement); Group 2 is still eligible for re-election (30 - 60 months left); Group 3 is the subjects under the management of the Politburo and Secretariat.
Accordingly, additional legal basis for resolving cases of early retirement violations, regulations for cases of non-violation but wishing to retire early... to resolve problems with cases of recent retirement.
Regarding the regime, the policy includes two regimes: Early retirement and retirement waiting for retirement age. In many cases, those who are not old enough to be re-elected but still choose to stay in work are very difficult to arrange a job position, so there should be a policy to encourage immediate retirement.
