Prime Minister: Need to control power in law making

The meeting discussed three draft laws including: Law on Amendments and Supplements to a Number of Articles of the Law on Security Guards, Law on Prevention and Combat of Human Trafficking (amended), Law on Notarization (amended); and two proposals for law making including: Law on Civil Judgment Enforcement (amended), Law on Corporate Income Tax (amended).

At the meeting, opinions were discussed on the contents of the draft law. In particular, the draft amendment to the Law on Security Guards clarified the necessity of applying security measures to subjects who are not security subjects; the Law on Prevention and Combating Human Trafficking (amended) focused on the need to continue to perfect relevant regulations on prevention and combating human trafficking...

With the draft Law on Notarization (amended), issues discussed include authority, scope of detailed regulations for law enforcement; decentralization, delegation of power, reform of administrative procedures; standards for notaries, training, appointment, dismissal of notaries...

The Law on Civil Judgment Enforcement (amended) includes the contents of decentralization and delegation of power in civil judgment enforcement; control of power, encouragement of expansion of civil agreements, but must be recognized by law; sanctions...

Regarding the Law on Corporate Income Tax (amended), the discussion contents are solutions to implement policies to ensure consistency and unity in the legal system. The goal is to create convenience and fairness for people and businesses when participating in the investment and business environment.

Determining the subjects of application of tax policies appropriate to each type of enterprise, agency, public unit, performing political tasks...; preferential policies; sanctions against tax losses; ensuring transparency, avoiding policy profiteering during implementation. Restructuring the state budget safely and sustainably...

Based on the opinions, the Prime Minister requested to seriously and fully absorb the opinions of Government members, complete the projects, proposals for law making, draft laws, proposals on law and ordinance making programs, and submit them according to regulations.

Emphasizing that "resources come from thinking, motivation comes from innovation, strength comes from the people", the Prime Minister affirmed that institutions, mechanisms and policies are the resources of development.

Innovation in law-making thinking

Therefore, it is necessary to innovate thinking in law-making; have mechanisms and policies to mobilize combined strength for development; innovate ways of doing things to create new resources and motivations, inspiring the whole society to develop.

It is necessary to emphasize the role of the leader in building legal policies, investing resources appropriately and improving policy response capacity. Listening to the opinions of experts and scientists, absorbing opinions from the business community, people and international experience.

The Head of Government also proposed to promote decentralization and delegation of power in conjunction with resource allocation. Strengthen inspection, supervision, and control of power. Cut down and simplify unnecessary administrative procedures to the maximum extent possible, and reduce compliance costs.

Remove all bottlenecks, unblock all resources for development; create a healthy development environment, regulate according to market mechanisms, avoid "asking - giving", prevent and combat group interests, policy corruption in the process of building and promulgating legal documents, and strictly handle violations.

With the Land Law (amended), laws related to real estate, housing, etc., the Prime Minister requested relevant ministries, branches, and agencies to complete the development of decrees and guiding circulars to soon put the law into practice, remove bottlenecks, and promote development.
