Reclaiming part of the land area leased to Manh Tuan Company Limited for a project in Bao Lam district

(LĐ online) - Lam Dong Provincial People's Committee has issued a decision to reclaim part of the land area leased to Manh Tuan Company Limited according to Decision No. 2611/QD-UBND dated November 16, 2011 of the Provincial People's Committee and assigned Loc Bac Forestry One Member Co., Ltd. to manage.

The total area of ​​land recovered and allocated is 31.34 hectares, belonging to part of sub-areas 397 and 398, Loc Bac commune, Bao Lam district. The reason for land recovery is the case of partial termination of the investment project according to the provisions of the law on investment stipulated in Point d, Clause 1 and Point d, Clause 5, Article 82 of the 2024 Land Law (the Department of Planning and Investment, now the Department of Finance, has partially terminated the operation of the investment project in Decision No. 64/QD-KHDT dated September 19, 2023).

Other contents in Decision No. 2611/QD-UBND dated November 16, 2011 of the Provincial People's Committee remain unchanged. The State does not compensate for land and assets attached to land according to the provisions of Clause 3, Article 101, Point a, Clause 3, Article 254 and Clauses 1 and 2, Article 105 of the 2024 Land Law.

Manh Tuan Company Limited is responsible for implementing the land recovery decision; handing over land and documents on land use rights to the competent authorities and persons as prescribed in the land recovery decision; continuing to manage and use for the right purpose the remaining 193.24 hectares of leased land in Decision No. 2611/QD-UBND dated November 16, 2011 of the Provincial People's Committee; scope and boundaries according to the map appraised by the Department of Natural Resources and Environment on January 10, 2025;

Manh Tuan Company Limited shall fully perform its outstanding financial obligations and arising financial obligations as prescribed by law; conduct an inventory of the current status of forest resources on the recovered land area, submit it to the competent authority for approval as a basis for considering and handling the responsibilities of relevant collectives and individuals in case of damage to the value of forest resources on the leased land area and related issues as prescribed by law.

Loc Bac Forestry One Member Co., Ltd. is responsible for receiving and strictly managing the assigned land area according to the provisions of the law on land, forestry and other relevant laws, not allowing encroachment or occupation of land in the assigned land area for management.

In case Manh Tuan Company Limited does not comply with the land recovery decision, the People's Committee of Bao Lam district is responsible for organizing the enforcement of the land recovery decision according to the provisions of Article 39 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government; arrange the budget or propose the allocation of budget to enforce land recovery according to the provisions of law;

The District People's Committee is also responsible for monitoring, detecting, preventing and promptly handling violations of the law on land management and use in the locality according to its authority, ensuring compliance with legal regulations; directing the People's Committee of Loc Bac commune to regularly organize inspections, detect, prevent and promptly handle according to its authority violations of the law such as land encroachment, land occupation, land destruction; improper land use; transfer and receipt of land use rights not in accordance with legal regulations and other violations of land law by land users.

In addition, the Provincial People's Committee also assigns responsibility to relevant departments and branches to perform duties and tasks according to assigned authority.
