Agree to propose adding 3 positions to the list of security guards

On the afternoon of May 20, continuing the 7th session, General To Lam - Politburo member, Minister of Public Security, authorized by the Prime Minister, presented a report on the draft Law amending and supplementing a number of articles of the Law on Guards.

General To Lam said that the Law on Guards was passed by the 14th National Assembly on June 20, 2017, and will take effect from July 1, 2018.

After 5 years of implementation, besides the positive results achieved, the process of implementing the Law on Security Guards has encountered some difficulties and inadequacies that need to be revised and supplemented.

Focusing on the following groups of issues: Objects of protection; measures and protection regimes; tasks and powers of the protection force.

For the group of human guards, the additional guards are the Standing Secretary of the Secretariat; Chief Justice of the Supreme People's Court; and Chief Prosecutor of the Supreme People's Procuracy.

These are the positions identified as senior leaders of the Party and State according to Conclusion No. 35 of the Politburo on the list of leadership positions and equivalent positions of the political system from the Central to the grassroots level.

According to Minister To Lam, security work always has many unpredictable and uncertain factors. In addition to ensuring security and safety, security personnel also actively serve foreign affairs and Vietnam's image with international friends.

Therefore, depending on the security and order situation at each specific time and case, the Minister of Public Security shall decide to apply appropriate security measures for each appropriate subject (within a certain scope and time) and in practice, the work of protecting national security requires the law to have regulations for timely adjustment.

In addition, Article 11 and Article 12 of the Law on Guards do not separate the guard regime and guard measures. Some guard regimes and measures are currently being implemented by the guard force but have not been stipulated in the law to ensure uniform application.

During the review, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Committee on National Defense and Security agreed with the addition of the Standing Secretary of the Secretariat, Chief Justice of the Supreme People's Court, and Chief Prosecutor of the Supreme People's Procuracy as security guards.

The addition of the above three titles and positions is consistent with the nature and importance of these positions in the political system.

The National Defense and Security Committee agreed with the provisions of the draft law and said that, in order to ensure absolute safety for the guard subjects, especially key leaders of the Party and State when going on business trips abroad, in case the guard force does not have enough manpower, means, and technical equipment to bring along, it is necessary to hire them.

Therefore, the National Defense and Security Committee basically agrees with the addition of regulations on hiring forces, means, and technical equipment to perform security work and must comply with the provisions of law on management and use of public assets and other relevant provisions of law.

However, regulations on hiring forces, means, and technical equipment must be consistent with the provisions of the law on security guards, the law on public property management, the law on the State budget, other relevant legal provisions, and must be strictly implemented to ensure absolute safety for the guarded subjects .
