Government Inspectorate points out many problems affecting the progress of Mai Son project

In particular, the Government Inspectorate recommended that the Ministry of Transport coordinate with the Ministry of Natural Resources and Environment to clarify a number of shortcomings in the investigation and survey of common construction material mines and the licensing process for mines used for key national transport projects.

Rectifying the investigation and survey of material mines

The inspection conclusion stated that at the time of inspection, the investigation, survey, and assessment of the reserves and quality of material mines serving the Mai Son - National Highway 45 construction investment component project had not yet met the actual construction requirements, with a large error rate. The number of mines surveyed was 37, but in actual construction, only 17 mines were able to supply materials for the project, while 20 mines were not able to supply materials (due to not meeting technical standards, no more reserves, not being licensed, problems with site clearance, etc.).

Notably, many mines in Thanh Hoa province have low exploitation capacity, unable to meet large supply in a short time... Therefore, Thang Long Project Management Board, consulting unit and construction contractors must add 45 more mines, including: 2 mines in Ninh Binh province, 43 mines and staging areas in Thanh Hoa province.

According to the Government Inspectorate, the results of the survey, sampling and selection of mining sites by the consulting unit are not consistent with reality. This is the reason why the contractor is passive in searching for sources of construction materials, greatly affecting the progress of the project.

In addition, construction contractors depend on the supply of construction materials from transport units, so at some times when gasoline prices increase, material suppliers as well as construction units are at a standstill, but investors do not have timely solutions to resolve and handle appropriately...

The construction of the price of fill soil in the bidding documents is carried out according to regulations but is still unrealistic and inaccurate, leading to fluctuations in the market, high transportation costs, or when the supply is scarce, the price of fill soil will fluctuate, while the contractor is only paid according to the winning bid price, so the construction is slow, affecting the progress, while the proportion of fill soil is very large, accounting for about 70% of the volume (about 13% of construction costs).

The Government Inspectorate pointed out that at the time of the inspection, the People's Committee of Ninh Binh province increased the capacity of 1 mixed soil and rock mine in Voi Trong mountain in Tam Diep city and the People's Committee of Thanh Hoa province issued 1 new mining license for Doi Ao soil and rock mine in Ha Trung district in accordance with the provisions of Resolutions No. 60/NQ-CP and Resolution No. 133/NQ-CP of the Government. However, the People's Committee of Thanh Hoa province issued Document No. 9507/STNMT-TNKS dated October 29, 2021 allowing other soil mines in the province to increase their capacity according to the needs of the expressway project; but did not require the mines to complete the procedures to increase their capacity according to the instructions in Resolution No. 60/NQ-CP and Resolution No. 133/NQ-CP of the Government. Comparing the volume of minerals used as construction materials for the highway project (Mai Son - National Highway 45 section), there is a difference between the report of the mineral exploitation project investor and the report of the Thang Long Project Management Board.

Strictly handle violations of selling construction materials to the market

From the above shortcomings, the Government Inspector General recommends that the Prime Minister direct the Ministry of Transport to rectify and improve the quality of investigation and survey of common construction material mines, issue specific regulations applicable to the investigation of common construction material mines for the Transport sector to ensure accuracy in terms of reserves according to time, progress, and technical standards before approving the project; there must be backup plans to ensure feasibility according to project requirements. Strictly handle project management boards and consulting units that have not fulfilled their responsibilities and have violated the investigation and survey of construction material supply sources for key national transport projects...

The Government Inspectorate recommends that the Ministry of Transport coordinate with the Ministry of Natural Resources and Environment to clarify some shortcomings in the investigation and survey of common construction material mines and the licensing process for mines used for key national transport projects; advise and report to competent authorities for decision, as a basis for implementation.

The Government Inspectorate recommends handling contractors who are slow to perform construction, do not comply with signed contracts, and do not ensure the approved progress of key national transport projects according to the law; inspect and examine the payment and settlement of the volume of common construction materials provided at the Mai Son - National Highway 45 expressway project. "In case of detecting signs of criminal law violations, transfer to the investigation agency for handling according to the law..." - the inspection conclusion clearly stated.

For the People's Committees of Ninh Binh and Thanh Hoa provinces, the Government Inspectorate recommends inspecting and reviewing mines with increased capacity according to Resolution 60/NQ-CP and Resolution 133/NQ-CP of the Government, determining the actual volume exploited to request the fulfillment of related financial obligations in accordance with the provisions of law, not to lose the state budget; inspecting the business at mines with increased capacity and Doi Ao mine, Thanh Hoa province, in case of violations of selling construction materials to the market without supplying them to the highway project, strictly handle according to Resolution 60/NQ-CP of the Government and the provisions of law.

In particular, immediately inspect, examine, and review mineral exploitation projects to clarify shortcomings and violations in licensing, mineral exploitation activities, compliance with legal regulations on land management, and implementation of related financial obligations; if signs of criminal law violations are detected during the implementation process, transfer them to the investigation agency for handling in accordance with the provisions of law.

The Government Inspector General also recommended that the Prime Minister direct the Ministry of Transport to direct the Thang Long Project Management Board, the consulting unit and relevant agencies and units to review the survey, sampling and selection of common construction material mines that have not met requirements, affecting the project's progress.
