The Government Inspectorate has just issued a notice of inspection conclusions on land management, use, planning and implementation of planning in Hung Yen province, period 2011 - 2022.
Through inspections of 19 land use projects, the Government Inspectorate discovered a series of limitations, shortcomings, and violations.
Of which, it was discovered that 4/19 approved projects did not go through bidding to select investors according to housing law, 7/19 projects had shortcomings and limitations in construction planning, 16/19 projects had shortcomings in determining land use fees, 11/19 projects were behind schedule...
Regarding the investment project to build technical infrastructure in subdivision A - urban area north of National Highway 5 in Pho Noi urban area, the Government Inspectorate requested the People's Committee of Hung Yen province to withdraw document No. 1488/2016 on continuing to assign Hoa Phat Urban Development and Construction Joint Stock Company as the investor to implement the project.
According to the inspector, at this time, the 2014 Housing Law and Decree 99/2015 of the Government do not have regulations on the transition to project implementation by using land funds to create capital for infrastructure construction.
Hung Yen must direct the authorities to review legal documents to re-auction and select investors for projects using land according to regulations.
"During the implementation process, if any violations of criminal law are discovered or if by June 30, 2025 the bidding for selecting an investor has not been conducted, the case will be transferred to the investigation agency for handling according to regulations," the inspection conclusion stated.
For projects such as Hoang Anh housing project, Hung Vuong Hung Yen Investment and Development Joint Stock Company project, commercial housing construction investment project, urban housing project... by the time of inspection, they have basically been completed, the investor has fulfilled financial obligations regarding land to the State or has sold, transferred real estate to households, individuals...
However, to ensure stability for people buying long-term housing and avoid complicated complaints, the People's Committee of Hung Yen province must base on legal regulations and review legal procedures to ensure compliance with the law and practice.
Review land financial obligations, re-determine land use fees, ensure correct and sufficient calculation of land use fees according to law, and avoid budget loss.
At the Lac Hong Phuc social housing and commercial housing project, the inspection agency requested Hung Yen province to direct the inspection and review of the addition, adjustment, and authorization from the investor to the project implementation unit in the investment policy decision and land allocation to the project implementation unit in accordance with legal regulations...
"The responsibility for the above limitations and shortcomings lies with the Chairman and Vice Chairman of the Provincial People's Committee in charge of the field and the provincial land valuation council during the relevant period.
Along with that are the Directors and Deputy Directors in charge of the departments of natural resources and environment, construction, finance...
In addition, responsibility also belongs to the Chairman and Vice Chairman of the People's Committee of districts, cities and towns during the relevant period, project investors and related organizations and individuals," the conclusion stated.
The Government Inspectorate recommends that the People's Committee of Hung Yen province urgently direct and organize the implementation of the inspection conclusions and recommendations, and take measures to correct, overcome and handle the limitations, shortcomings and violations mentioned.
"In the process of implementing the inspection conclusion, if any case of loss of state budget or signs of violation of criminal law is discovered, it must be transferred to the investigation agency for handling," the Government Inspectorate requested.
