(Dan Tri) - The Ministry of Justice coordinates with ministries and ministerial-level agencies to review documents related to the organization and streamlining of the Government's apparatus. This ensures that there are no legal gaps in the arrangement process.
On December 12, Mr. Ho Quang Huy, Director of the Department of Inspection of Legal Normative Documents (Ministry of Justice), chaired a working session with representatives of ministries and ministerial-level agencies on the implementation of the task of reviewing documents related to the organization and streamlining of the Government's organization.
Mr. Huy affirmed that the scope of reviewing documents related to this matter is very broad, while the time is urgent.

The Department of Inspection of Legal Normative Documents recommends that the review must ensure completeness, accuracy, and detail of directly related legal provisions, thereby making recommendations and proposals for amendments, supplements, abolition, replacement, or new issuance.
Problems also need to be resolved to meet the requirements of organizational restructuring, ensuring there are no legal gaps in the restructuring process.
The subjects of review are all legal documents under the review responsibility of ministries and ministerial-level agencies as prescribed in Clause 1, Article 139 of Decree No. 34/2016 of the Government detailing a number of articles and measures for implementing the Law on Promulgation of Legal Documents (amended and supplemented by Decree No. 154/2020) still in effect as of December 15, subject to the impact of organizational restructuring.

At the meeting, representatives from ministries and ministerial-level agencies raised a number of difficulties regarding the subjects, scope, content, and methods of review and hoped that the Ministry of Justice would continue to guide the implementation of this task.
Concluding the meeting, Mr. Ho Quang Huy requested ministries, ministerial-level agencies, and relevant units under the Ministry of Justice to closely follow the instructions and promptly review documents to ensure progress and deadline for reporting to the Steering Committee to summarize the implementation of Resolution No. 18-NQ/TW on the plan to guide the arrangement and streamlining of the Government's apparatus.
The Department of Document Inspection will act as the focal point, coordinating with ministries and ministerial-level agencies to remove difficulties and obstacles in the implementation process.
As reported by Dan Tri , at a working session with the Standing Committee of the Ho Chi Minh City Party Committee on the afternoon of December 11, Minister of Justice Nguyen Hai Ninh said that the Ministry was assigned by the Government to review all legal documents related to streamlining the apparatus.
"Through the initial preliminary review, there are up to 184 laws and 200 related decrees that need to be amended, not to mention the Prime Minister's decisions, resolutions and decrees of the Government," Mr. Ninh informed.
The Minister of Justice said that when merging ministries, along with multi-sector and sectoral management, decentralization and delegation of power to localities is very necessary. Through review, the ministry found that there are about 174 specialized laws that need to be amended, not to mention other relevant decrees and legal documents.
"If we merge ministries and manage multiple sectors and fields, no matter how talented a minister is, he cannot cover such a large field," Mr. Nguyen Hai Ninh shared.
The Ministry of Justice, together with ministries and agencies of the National Assembly, advises the Government, the National Assembly, and competent authorities to amend laws in the upcoming National Assembly session.
