On December 25, the Office of the President held a press conference to announce the President's Order on promulgating 7 Laws passed by the 15th National Assembly at its 6th Session. Among them is the Housing Law. The Law consists of 13 chapters and 198 articles, effective from January 1, 2025.

The development of the Housing Law (amended) aims to promptly institutionalize the Party's guidelines and policies and the State's policies in developing housing for the people, especially low-income people and the poor who are unable to create housing according to the market mechanism; amend and perfect the provisions of the 2014 Housing Law in accordance with the actual situation, remove existing problems and limitations, ensure the constitutionality, consistency and synchronization between the provisions of the Housing Law (amended) and other relevant laws.

The Law adds two new forms: developing workers' accommodation and developing housing for the people's armed forces.

The law stipulates that the Vietnam General Confederation of Labor is the governing body of social housing construction investment projects using trade union financial resources.

Regarding the issue of developing multi-storey housing, many apartments of individuals for sale and rent (also known as "mini apartments"), according to Deputy Minister of Construction Nguyen Van Sinh: The law has strict regulations, in which it stipulates that this type of housing meets the conditions in Clause 1, Article 57 of the Housing Law 2023, will have a basis for granting pink books, and can be sold, leased, or rented according to the law. This is a legal basis for recognizing the individual ownership of each "mini apartment".

According to the 2023 amended Housing Law, investors are exempted from land use fees and land rent for the entire land area of ​​the project. In addition, investors do not have to carry out procedures for determining land prices, calculating exempted land use fees and land rent, and do not have to carry out procedures for requesting exemption from land use fees and land rent.

The new point in the 2023 amended Housing Law is that investors are entitled to a maximum profit of 10% of the total construction investment cost for the area of ​​social housing construction, and are allowed to reserve a maximum of 20% of the total residential land area within the project area for investment in the construction of technical infrastructure systems to invest in the construction of business, service, commercial and commercial housing works.

The investor of a social housing construction investment project shall account separately, and shall not include the investment cost for the construction of the service, commercial, or commercial housing facilities in the cost of the social housing, and shall enjoy all profits from the area of ​​the service, commercial, or commercial housing facilities; in the case of investment in the construction of commercial housing, the investor shall pay land use tax on the area of ​​the commercial housing construction according to the provisions of the law on land.

The Law amends and supplements 2 groups of subjects entitled to social housing support policies. These are students of universities, academies, colleges, vocational schools, and specialized schools as prescribed by law; students of public ethnic boarding schools and enterprises, cooperatives, and cooperative unions in industrial parks.

The 2023 amended Housing Law stipulates that within a period of 5 years, the buyer or hire-purchaser may only resell to the investor of the social housing construction investment project or resell to subjects eligible to buy social housing at a maximum selling price equal to the selling price of this social housing in the sales contract with the investor of the social housing construction investment project.
