The draft Railway Law (amended) adds and amends many regulations on the responsibility for maintaining and evaluating the safety management system and facilitating transportation.
The Ministry of Transport stated that the 2017 Railway Law already includes regulations on safety management systems, such as: urban railways and high-speed railways, whether newly constructed or upgraded, must undergo system safety assessment and certification before being put into operation.
Businesses operating urban rail and high-speed rail must establish and maintain a safety management system.

Specifically for urban railways, the Minister of Transport is tasked with regulating the implementation of safety assessment and certification for urban railway systems and issuing Certificates of Assessment of Urban Railway System Safety Documents, and Certificates of Periodic Assessment of Urban Railway Operational Safety Management Systems.
However, implementing these regulations remains challenging. Specifically, while the authority to evaluate and certify urban railways is assigned to the Minister of Transport, urban railway construction investment projects fall under the jurisdiction of provincial People's Committees.
Therefore, the Draft Law on Railways (amended) has added a provision assigning responsibility to organizations managing and operating railways to establish and maintain a safety management system to improve railway transport operations, especially for railway projects with high technical requirements that are scheduled for implementation in the near future.
On the other hand, such regulations are consistent with railway laws in other countries around the world , including China, which has a direct railway connection with Vietnam. This ensures convenience for international intermodal transport.
The draft law also amends and supplements regulations on the assessment and certification of railway system safety, building upon and modifying existing railway law to align with international practices.
At the same time, regulations regarding administrative procedures for the assessment and issuance of Certificates of System Safety Assessment and Certificates of Periodic Assessment for Urban Railway Operation and Management Systems will be abolished. This will remove difficulties and obstacles for investors and businesses when investing in, constructing, managing, and operating urban railway lines.
The system safety assessment and certification will be carried out by an independent safety certification body (selected by the project owner).
