DNVN - Sharing at the Workshop to collect opinions from development partners on the draft Law on Public Investment (amended) on September 13, Deputy Minister of Planning and Investment Tran Quoc Phuong emphasized that one of the five groups of policies to be amended is to promote the disbursement of ODA capital and preferential loans from foreign donors by designing a separate chapter.
Deputy Minister Tran Quoc Phuong said that the Ministry of Planning and Investment has reviewed and reported to competent authorities to amend public investment laws and regulations in the direction of simplifying procedures, including 29 new policies, focusing on 5 groups of fields.
One of the five policy groups amended in the Public Investment Law is to promote the implementation and disbursement of official development assistance (ODA) and preferential loans from foreign donors by designing a separate chapter. The comprehensive amendment of the Public Investment Law aims to fundamentally overcome difficulties, limitations, obstacles, and bottlenecks. At the same time, it improves the efficiency of capital use and unlocks resources for development.

Representatives of development partners highly appreciated the draft of the Law on Public Investment (amended), especially the policies on ODA projects. Outstanding policies discussed and highly appreciated were the decentralization and delegation of authority in approving and implementing projects; simplification of project investment procedures; and separation of compensation and site clearance into independent projects.
Donors also hope that the Government will soon issue a guiding Decree so that the law can be implemented immediately after it takes effect.
Ms. Susan Lim - Senior Portfolio Management Specialist, Resident Representative Office of the Asian Development Bank (ADB) in Vietnam said that the main goal of amending the law is to make the most effective use of ODA capital. For urgent projects, the law needs to have specific regulations to be able to use capital more effectively.
Mr. Herve Conan - Country Director of Vietnam, French Development Agency (AFD) expressed his support for the contents of the draft Law on Public Investment (amended) related to simplifying procedures, having a separate chapter on ODA, continuing to decentralize power to localities to promote the implementation of investment projects. The AFD representative proposed that important national projects should be implemented more quickly and flexibly.

Mr. Daniel Plankermann - Director of the German Reconstruction Bank in Vietnam commented that the impact of changes in the draft Law on Public Investment (amended) is positive, and can unlock potential in the implementation of ODA projects.
“The important thing is how the circulars are guided. Other legal documents must be changed to ensure consistency and synchronization with the Law on Public Investment (amended). During the transition, there will be risks due to policy changes. How to simplify the transition process so that the projects in preparation can also benefit,” said Mr. Daniel Plankermann.
Responding to this opinion, Deputy Minister Tran Quoc Phuong affirmed that the law submission dossier has been accompanied by a draft decree guiding its implementation. The guiding document will be further completed when the law is passed by the National Assembly in the direction that projects in the preparation process (with some clearly defined conditions) will also benefit.
