Chairman of Vinh Phuc Provincial People's Committee Tran Duy Dong has just issued a document on the implementation of the transition of management of programs, tasks, and public investment projects in the process of arranging and perfecting the provincial apparatus.
Accordingly, provincial leaders classify specific cases in the transition plan for managing programs, tasks, projects and public investment plans.
For agencies and units subject to consolidation or merger, the head of the newly formed agency after consolidation or merger is responsible for performing the functions of the competent person and investor for all programs, tasks, projects and public investment plans of the original agencies and units. The management of programs, tasks, projects and capital plans is carried out in accordance with the provisions of the Law on Public Investment and related laws. The original agencies and units are responsible for developing a plan to consolidate the entire list of programs, tasks, projects and capital plans under their management.

For agencies and units subject to reorganization, transfer, and function acceptance: After the competent authority decides on the reorganization (reorganization, transfer, and function acceptance), the receiving agency is responsible for receiving the entire list of programs, tasks, projects, and public investment plans according to the transferred fields and according to the division plan determined by the head of the agency or unit transferring the functions.
Before transferring functions and tasks, the head of the agency or unit transferring or assigning functions and tasks is responsible for determining and dividing the specific list of programs, tasks, projects and public investment plans according to the transferred field (list of projects, assigned capital plans, records, documents, etc.), and sending them to the receiving agency corresponding to the transferred field.
The receiving agency will consolidate the entire list of programs, tasks, projects, and public investment capital plans under its management after reorganization; and manage plans and projects in accordance with the provisions of the Law on Public Investment.
The transition of management of programs, project tasks and public investment plans is closely related to the legal status of relevant competent legal entities according to the provisions of the law on public investment; therefore, it is recommended that agencies and units seriously implement this after competent authorities decide on the arrangement and consolidation of the organizational apparatus of agencies, units and localities of Vinh Phuc province for unified implementation.
Handover immediately after the arrangement decision
In order to facilitate the transition of management of programs, tasks, projects, and public investments during the process of restructuring and perfecting the provincial apparatus, Chairman of Vinh Phuc Province Tran Duy Dong requested: Agencies and units subject to restructuring need to proactively review the list of assigned projects and public investment plans to develop a handover and acceptance plan when restructuring and perfecting the apparatus. They are responsible for developing and agreeing on a transition plan for management of programs, tasks, and projects for the list of assigned projects and public investment plans.
After the competent authority decides on the arrangement and reorganization, the heads of agencies and units subject to the arrangement and streamlining of the apparatus shall hand over each project between agencies and units according to regulations.
Before handing over the project to the new agency or unit, the agencies and units are responsible for comparing payment data and capital plans with the State Treasury to ensure accurate data.
The new agency or unit after the arrangement and the original agency or unit are responsible for determining the implementation status, capital allocation figures, advances, disbursements, project documents, etc. to sign the handover minutes according to regulations. The handover and acceptance of contents related to programs, tasks, projects and public investment plans must be completed by relevant agencies and units immediately after the competent authority issues a decision on the arrangement and streamlining of the organizational apparatus, etc.
