September 2023 holiday schedule for officials, civil servants, public employees and workers.

Pursuant to Article 111, Article 112 of the 2019 Labor Code and Notice 5034/TB-LĐTBXH in 2023, the days off with full pay in September 2023 of cadres, civil servants, public employees and employees at non-state companies (private companies) are implemented as follows:

1. Holidays in September 2023 for cadres, civil servants and public employees

In September 2023, cadres, civil servants and public employees will have a total of 09 days off per week, including: September 2, 03, 09, 10, 16, 17, 23, 24, 30, 2023 (including 05 Saturdays and 04 Sundays).

According to Notice 5034/TB-LĐTBXH in 2023, on the occasion of National Day 2023, cadres, civil servants and public employees will have a day off from Friday, September 1, 2023 to Monday, September 4, 2023. This holiday includes 02 National Day holidays, 01 weekly day off and 01 compensatory day off for the weekly day off as prescribed in Clause 3, Article 111 of the 2019 Labor Code.

Thus, in September 2023, cadres, civil servants and public employees will have a total of 11 days off and receive full pay (09 weekly days off and 02 holidays).

2. Days off in September 2023 for employees with 02 days off per week (Saturday and Sunday)

In September 2023, employees in this case will have the same number of weekly days off as the ministries, civil servants and public employees in Section 1, which is 11 days. However, for the National Day holiday, there will be 2 cases as follows:

- In case the employer chooses the National Day 2023 holidays as Friday, September 1, 2023 and Saturday, September 2, 2023, the employee will have 4 consecutive days off (from Friday, September 1, 2023 to Monday, September 4, 2023); including 2 holidays, 1 weekly day off and 1 compensatory day off for the weekly day off.

- In case the employer chooses the National Day 2023 holidays as Saturday, September 2, 2023 and Sunday, September 3, 2023, then on the occasion of National Day 2023, employees will have 4 consecutive days off (from Saturday, September 2, 2023 to Tuesday, September 5, 2023); including 2 public holidays and 2 compensatory days off for weekly holidays.

3. Holidays in September 2023 for employees with 1 day off per week (Sunday)

In September 2023, employees in this case will have a total of 06 days off. Specifically as follows:

(i) 04 Sundays, including: September 03, 10, 17, 24, 2023.

(ii) 02 holidays:

- In case the employer chooses the National Day 2023 holidays as Friday, September 1, 2023 and Saturday, September 2, 2023, then on the occasion of National Day 2023, employees will have 03 consecutive days off (from Friday, September 1, 2023 to Sunday, September 3, 2023); including 02 holidays and 01 weekly day off.

- In case the employer chooses the National Day 2023 holidays as Saturday, September 2, 2023 and Sunday, September 3, 2023, the employee will have 03 consecutive days off (from Saturday, September 2, 2023 to Monday, September 4, 2023); including 02 public holidays and 01 compensatory day off for a weekly day off.

4. Note on the Notice of National Day Holiday 2023

Enterprises must notify employees of the 2023 National Day holiday plan at least 30 days before implementation.

Article 111. Weekly rest - Labor Code 2019

1. Each week, employees are entitled to at least 24 consecutive hours of rest. In special cases where weekly rest is not possible due to the work cycle, the employer is responsible for ensuring that employees have an average of at least 4 days off per month.

2. The employer has the right to decide to arrange the weekly day off on Sunday or another specified day of the week, but must record it in the labor regulations.

3. If the weekly day off coincides with a public holiday as prescribed in Clause 1, Article 112 of this Code, the employee shall be entitled to take the weekly day off in lieu on the next working day.

Article 112. Holidays and Tet holidays - Labor Code 2019

1. Employees are entitled to take time off with full pay on the following holidays:

a) New Year's Day: 01 day (January 1st);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30);

d) International Labor Day: 01 day (May 1st);

d) National Day: 02 days (September 2 and 01 day before or after);

e) Hung King's Commemoration Day: 01 day (10th day of the 3rd lunar month).

2. Foreign employees working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are also entitled to 01 traditional New Year's Day and 01 National Day of their country.

3. Every year, based on actual conditions, the Prime Minister shall decide on specific holidays specified in Point b and Point d, Clause 1 of this Article.
