The case of a 2-month-old baby girl in Da Lat City (Lam Dong Province) being abused by her mother's lover has caused public outrage in recent days.
Lam Dong Provincial Police have initiated a case, prosecuted the accused, and temporarily detained Tran Hoai Thuong (33 years old, residing in Ward 2, Da Lat City) to investigate the murder. Thuong was identified as the person who abused NNTC (born February 25, 2023, residing in Ward 3, Da Lat City) and had to be hospitalized in critical condition.

Responding to VTC News reporter, lawyer Nguyen Van Tu - Da Nang City Bar Association said that Tran Hoai Thuong's behavior was very cruel and inhumane, so an urgent arrest for criminal prosecution was necessary.
According to lawyer Nguyen Van Tu, this is a serious incident that has caused public outrage, and the authorities will soon clarify it and handle it according to the law. So far, Thuong has admitted to repeatedly beating the child, causing the victim to be hospitalized in a coma, with brain damage, multiple injuries, and a broken arm and femur.
Specifically, Thuong performed a series of actions of hitting and slapping C. hard on the head and face; using a pacifier, placing it in C.'s mouth and then taping it around so that she wouldn't cry; shaking C. vigorously with her hands,... resulting in C. breaking her left forearm and right arm, breaking both femurs, and suffering a traumatic brain injury... Thuong performed the above series of actions many times, brutally.
The victim was only a newborn baby, whose body was still very weak and vulnerable, and any physical impact on the body could endanger his life. Tran Hoai Thuong was a person with full criminal capacity, knew and was aware that his actions were dangerous and likely to result in the death of the baby, but still intentionally committed them. Therefore, Tran Hoai Thuong's act of violence against a baby just over 2 months old must be strongly condemned and strictly handled in accordance with the provisions of the 2015 Penal Code.
Thuong's above actions have all the elements of the crime of "Murder" according to Article 123 of the Penal Code. Article 123 of the 2015 Penal Code (amended and supplemented in 2017) stipulates that those who commit the act of murdering a person under 16 years old will face a prison sentence of 12 to 20 years, life imprisonment or the death penalty. "Thus, for the act of murdering a person under 16 years old, with a hooligan nature, Thuong may face a penalty of 12 to 20 years, life imprisonment or the death penalty," lawyer Nguyen Van Tu informed.
Lawyer Tu also said that Tran Nhu Thuong's criminal acts violated the right to protection of body, health, honor, dignity and violated human life, especially the life of children, who are vulnerable people not only protected by the Constitution and law but also protected by international conventions on children's rights that the Socialist Republic of Vietnam has participated in, recognized and protected.
According to lawyer Nguyen Van Tu, Tran Hoai Thuong's behavior needs to be strongly condemned and severely punished.
Regarding the case, C.'s mother, Nguyen Phuc Hong An (22 years old, residing in Ward 3, Da Lat City) was also summoned for investigation. However, after determining her identity, background and considering humanity, the police agency allowed the family to bail An to return home to take care of C. who is being treated at the hospital.
In the case of Nguyen Phuc Hong An, An witnessed her child being abused by her lover many times but did not intervene or report to the authorities in time. According to lawyer Nguyen Van Tu, with this behavior, the authorities also need to consider the responsibility of Nguyen Phuc Hong An as an accomplice who mentally supported Thuong in committing the crime.
"Recently, there have been consecutive cases of brutal child abuse discovered. Now, there is the case of baby C., which shows the alarming situation of child abuse, and even more sadly, the ones causing pain to the children are their biological parents and their lovers. The case once again shows that children are at risk of being protected and abused anywhere, even when they are still under the care and education of their parents," lawyer Nguyen Van Tu warned.
As reported by VTC News, on the evening of May 20, C. was taken to the emergency room at Lam Dong General Hospital. The child was admitted in a coma, with brain damage, multiple injuries, and a broken arm and femur.
At the hospital, the patient’s mother said the child had been beaten by a neighbor a week ago. However, seeing the girl’s unusual injuries, hospital leaders reported it to the authorities.
Upon receiving the news, the leaders of the Da Lat City People's Committee went to the hospital to visit the child and asked the police to clarify the incident. The Da Lat City Police later determined that the girl was hospitalized due to abuse and the suspect in the incident was Tran Hoai Thuong.

At the investigation agency, Tran Nhu Thuong confessed that since An brought C. to live with him at the motel, Thuong had repeatedly abused the child after using crystal meth. Thuong repeatedly used his hands to hit the child's face, head, arms and legs, causing serious injuries.
At 1am on May 20, after using crystal meth in a rented room, Tran Nhu Thuong lifted the child up by the armpits to torture him by shaking him violently. This time, C. suffered severe trauma and fell into a deep coma. Fearing that C. would die, Tran Nhu Thuong took the child to Lam Dong General Hospital for emergency treatment and then fled.
