Lam Dong Provincial Police are investigating the case of the owner of the Sculpture Tunnel tourist area accusing Lam Dong Provincial Tax Department officials of forging records.

On March 11, Lam Dong Provincial Police said they were investigating the case of the director of Sao Da Lat Company (owner of the Sculpture Tunnel Tourist Area) accusing the inspection team of the Lam Dong Provincial Tax Department of falsifying the minutes of the dialogue and questioning.
Lam Dong police accepted the case.
Previously, the Department of Investigation Police on Crimes of Corruption, Economy, and Smuggling (Ministry of Public Security) transferred the complaint of Sao Da Lat Joint Stock Company to the head of the Investigation Police Agency of Lam Dong Provincial Police for settlement according to authority.
Specifically, Mr. Trinh Ba Dung - General Director of Sao Da Lat Company (Da Lat Sculpture Tunnel tourist area) - sent a petition to the police agency to denounce the inspection team of the Lam Dong Provincial Tax Department for falsifying their work when they created their own minutes of dialogue and questioning with this enterprise.
According to the complaint, before the end of the 10-day inspection at the Da Lat Sculpture Tunnel, the inspection team independently prepared two minutes of dialogue and questioning No. 07b/BB-TTr dated February 6, 2025 and No. 07c/BB-TTr dated February 12, 2025. According to him, these minutes were signed by members of the inspection team in advance, but in reality, there was no dialogue or questioning with Sao Da Lat Company.

The alleged forged minutes mainly revolve around the financial accounting of Sao Da Lat Company in 2020; the company's lawsuit against the decision to impose administrative penalties on tax audit results in the 2016-2017 period; and the company's entitlement to corporate income tax.
At the press conference on March 11, Colonel Le Hong Phong said that the Economic Police Department (Lam Dong Provincial Police) has received the case file, implemented verification measures, collected documents and evidence to clarify in accordance with the law.
Tax Department says the records are genuine
In the dialogue minutes, there is a handwriting of the Chief Accountant of Sao Da Lat Company, Mr. Nguyen Vo Le Huy, with the content: "The company did not have a dialogue on this content, the tax authority made it itself and forced the company to sign" and "I received this minutes (07c/BB-TTr - PV) but the Inspection Team did not have any dialogue or questioning on these contents. I request the competent authority to consider my opinion".
Regarding the time of issuing the minutes of questioning and dialogue, a noteworthy point: the inspection ended on January 22, 2025, but the minutes of dialogue were made on February 6, 2025 and February 12, 2025.

Speaking to the press, the Lam Dong Provincial Tax Department affirmed that the minutes of dialogue and questioning sent to the enterprise were real. When sent to the enterprise, the minutes left a few blank lines for the enterprise representative to write down their opinions.
In addition, when handing over the minutes, the members of the inspection team must sign them before handing them over to the business for comments. Because there are disagreements between the business and the inspection team, the team has created additional minutes of dialogue and questioning for the business to express their opinions.
The purpose of the minutes of dialogue and questioning is for the Tax Department to further explain the reasons why the enterprise is not entitled to tax incentives and to answer issues that the enterprise has previously submitted in writing.
At a recent meeting with citizens at the end of February 2025, Mr. Tran Hong Thai, Chairman of Lam Dong Provincial People's Committee, said that he had received the case and assigned the Director of Lam Dong Provincial Police to clarify it.
According to Mr. Thai, this matter is under the jurisdiction of the judiciary, and he will follow up closely. Mr. Thai affirmed that Lam Dong province is committed to always putting the interests of the people, including companies and businesses, first.
Sao Da Lat once sued the Tax Department of Lam Dong province
The Dalat Star Resort project was granted an investment certificate by the Lam Dong Provincial People's Committee in 2008. The Lam Dong Provincial Tax Department once collected additional taxes because it believed that the Dalat Sculpture Tunnel project was not eligible for incentives. The Lam Dong Provincial Court once conducted mediation, but the case has not yet ended.
In 2021, Sao Da Lat Joint Stock Company sued the Director of Lam Dong Provincial Tax Department for violating the law during the inspection process and making illegal decisions.
The Provincial Tax Department later annulled the above decisions. The Lam Dong Provincial People's Court issued a decision recognizing the results of the dialogue between the parties, namely Sao Da Lat Company, the Lam Dong Provincial Tax Department and the Department of Planning and Investment (representing the Lam Dong Provincial People's Committee).
The court also suspended the case because the Provincial Tax Department issued a decision to cancel the decisions sued by the company and Sao Da Lat Joint Stock Company withdrew the lawsuit.
