Site clearance for Nhat Le 3 Bridge project: Determination and drastic implementation

(QBĐT) - Component 2 project - Nhat Le 3 bridge and the road at both ends of the bridge under the Coastal Road and Nhat Le 3 bridge project is considered one of the very important projects for the socio-economic development of the province. Recognizing that, in recent times, the Provincial People's Committee has paid special attention to directing and departments, branches, units, and localities to focus on coordinating implementation, especially in site clearance work.

Component 2 project - Nhat Le 3 bridge and the roads at both ends of the bridge have a total length of more than 2.8km; of which Nhat Le 3 bridge has a length of 561.4m, a width of 23.5m; the road at the western end of the bridge connects to National Highway 1 in the old Luong Ninh commune (Quang Ninh); the eastern end connects to the coastal road in Bao Ninh commune (Dong Hoi city). The project has a total investment of 1,300 billion VND and is implemented in 2022-2026, with the Department of Planning and Investment (now the Department of Finance) as the investor.

The representative of the Management Board of the Infrastructure Project for Comprehensive Development of Quang Binh Province (the unit assigned to manage the project) said: The total area of ​​land recovered for site clearance is 15.33 hectares. The compensation and site clearance work for the project is related to the old Luong Ninh commune (Quang Ninh) with an area of ​​3.6 hectares and Bao Ninh commune (Dong Hoi city) with an area of ​​11.73 hectares. Currently, 8.58 hectares have been completed and 6.75 hectares are being implemented in Bao Ninh commune (of which, 1.35 hectares are being appraised for assets, 1.71 hectares are waiting for procedures to appoint a land valuation unit, 3.69 hectares have been approved by the Department of Agriculture and Environment for measurement, and are currently preparing documents to submit for land acquisition notification).

Compensation and site clearance work is facing problems in determining compensation prices for assets, as well as the scope of affected aquaculture farms; resettlement; problems related to policies and compensation prices, resettlement support according to the 2024 Land Law... which have greatly affected the results of site clearance work.

Specifically, regarding policies and feasibility when applying, such as: Specific land valuation to calculate compensation is priced according to the market, including valuation of agricultural land adjacent to residential land (agricultural land adjacent to residential land was previously garden land - now according to the provisions of the 2024 Land Law, there is no longer garden land). For households whose entire land plots are recovered, including residential land and garden land, and the recovered person requests compensation with land containing both residential land and garden land (now called agricultural land and no garden land according to the 2024 Land Law), according to Decree No. 88/2024/ND-CP, dated July 15, 2024 of the Government regulating compensation, support, and resettlement when the State recovers land, there are no specific regulations on compensation by land, allocation of resettlement land containing both residential land and agricultural land in the same residential land plot, so the GPMB consulting unit is stuck in planning a resettlement plan and compensation by land.

Regarding specific problems: During the process of counting about 1.71 hectares of agricultural land (belonging to the first, second, and third announcements), some crop assets encountered problems in the compensation price application, such as fruit trees and industrial trees with trees in the harvest period being counted to apply prices in VND/kg according to the 2024 Land Law. At the same time, 1.35 hectares of aquaculture land of Duc Thang Joint Stock Company has been counted since March 2024, but a compensation plan has not been established, because some assets are not included in the province's price list. It is necessary to collect asset quotes, run input estimates, submit to competent authorities for approval of the price plan, and then apply to establish and publicize the plan.

The Provincial People's Committee emphasized: To complete the above specific work timelines, in addition to implementing the procedures for compensation, site clearance, propaganda, and mobilization according to the provisions of law and the actual situation..., units and localities need to proactively coordinate in developing plans to enforce/protect construction in case households resist and do not cooperate.

Faced with many difficulties and problems regarding land acquisition and site clearance that need to be resolved, but time is running out, the Provincial People's Committee recently held a meeting and directed relevant departments, branches, units and localities to be determined and resolute in coordinating implementation to help the project complete on schedule. Specifically, for component project 2 - Nhat Le 3 bridge and the road at both ends of the bridge, the Provincial People's Committee directed the People's Committee of Dong Hoi City to complete the valuation of the aquaculture pond assets of Duc Thang Joint Stock Company and carry out procedures to apply the approved unit price for the project in March 2025; complete the land valuation for 0.35ha of land of 2 households at the beginning of the bridge and 1.36ha of land for annual crops on the east side of Nguyen Thi Dinh street (Bao Ninh commune) in March 2025 and complete the approval of the compensation and land acquisition plan in April 2025; Strive to complete site clearance of the remaining 3.69 hectares in May 2025.

Previously, to resolve some problems and difficulties, on February 26, 2025, the Provincial People's Committee issued Decision No. 12/2025/QD-UBND amending and supplementing a number of articles of Decision No. 33/2024/QD-UBND, dated October 31, 2024 on regulations on unit prices for compensation for damage to crops and livestock when the State acquires land in the province to supplement data on some new types of trees to provide a basis for pricing. The Provincial People's Committee also directed departments, branches and localities to develop a new land price list to replace the land price in Decision No. 40/2019/QD-UBND, dated December 20, 2019 to have a basis for adjusting the established compensation plan.

The leader of Dong Hoi City People's Committee said: Implementing the direction of the Provincial People's Committee, the City People's Committee continues to coordinate with the project investor and relevant localities and units to organize field inspections and review meetings to remove remaining difficulties and obstacles in site clearance work in order to promptly complete assigned tasks within the deadline directed by the Provincial People's Committee; assign tasks and deadlines for completing specific tasks to each unit and locality.
