
Implementing decentralization of land use conversion to implement 6 projects
Resolution No. 36 of the National Assembly stipulates the piloting of a number of specific mechanisms and policies for the development of Nghe An province on financial management, state budget and decentralization of state management in the fields of land, forests and planning.
To implement Resolution No. 36, the Department of Natural Resources and Environment and the Department of Agriculture and Rural Development have proactively coordinated with the Department of Planning and Investment to advise the Provincial People's Committee and closely follow the Central Ministries and branches to submit to the Prime Minister to promulgate the process, order and procedures for implementation.

Up to now, based on the authority to convert the purpose of using 2-rice land and converting the purpose of using forest which is decentralized to the province according to Resolution No. 36 of the National Assembly; the departments have advised and proposed the Provincial People's Committee to submit to the Provincial People's Council for approval to convert the purpose of using 2-rice land and production forest land to implement 6 projects and works. Specifically, more than 110 hectares of 2-rice land have been converted to implement 5 projects and works and nearly 86 hectares of planted forest land have been converted to implement 1 project.
Among the projects implementing land use conversion, there are some projects focusing on implementing compensation and site clearance, gaining consensus from the people. For example, the Silica Sand Mining Project in Quynh Loc Commune (Hoang Mai Town) has completed the clearance of nearly 86 hectares of production forest land; or the Dien Thang Industrial Cluster Project in Minh Chau Commune (Dien Chau District) is also clearing the site, with only 6 households remaining.

Decentralization has created the initiative for Nghe An province to decide on land use conversion to implement projects in a timely manner, meeting the requirements of administrative reform and improving provincial competitiveness. During the implementation process, the departments also reported some shortcomings and difficulties in implementing Resolution No. 36 of the National Assembly.
Specifically, Resolution No. 36 of the National Assembly allows the decentralization of land use purpose conversion to the People's Council of Nghe An province to decide on double-rice land. However, the province does not have the authority to decide on the conversion of land use purpose for single-crop rice cultivation over 10 hectares or protective forest land, special-use forest land for wind and sand protection, so it is difficult for some projects. On the other hand, regarding the procedure of 3 times of consulting the opinions of people whose land is recovered, the community is also having some problems.

From the shortcomings, the departments proposed that the National Assembly and the Government study, amend and supplement specific regulations on the Prime Minister's decentralization of land use purpose conversion to the People's Council of Nghe An province to allow the conversion of land use purpose for wet rice cultivation from 02 crops or more; protective forest land, special-use forest land in the upstream includes the conversion of other land use purpose for rice cultivation, not just wet rice cultivation land from 02 crops or more and protective forest land, other special-use forest land, not just protective forest land, special-use forest land in the upstream.
For the Government and the Ministry of Natural Resources and Environment, it is recommended to integrate the content of collecting opinions in the direction of only organizing one-time consultation for land users affected by the project, including land recovery, land use purpose conversion, and environmental impact assessment.


Research and recommend to the National Assembly to remove obstacles
Based on a direct survey of projects implementing land use conversion that were delegated authority to the province according to Resolution 36 of the National Assembly, along with the implementation reports of the departments at the meeting; on behalf of the National Assembly Delegation of the province, Comrade Thai Thi An Chung - Member of the Provincial Party Executive Committee, Deputy Head of the National Assembly Delegation of Nghe An province acknowledged the proactiveness and positivity of the sectors in advising and following the Central Ministries and sectors to implement and bring Resolution 36 of the National Assembly into life.

On the other hand, during the implementation process, some problems, difficulties and shortcomings arose; the departments also promptly reported to the Provincial People's Committee and made recommendations to the Central Government for solutions.
Regarding the responsibility of the Provincial National Assembly Delegation, it has also compiled and included the voters' recommendations before the 5th session of the 15th National Assembly and sent them to the Ministry of Natural Resources and Environment to advise the Government on amendments.

The Deputy Head of the National Assembly Delegation of Nghe An Province also said: Resolution 36 of the National Assembly not only creates a breakthrough mechanism for Nghe An Province, but also serves as a pilot to implement new mechanisms and policies; at the same time, the National Assembly's viewpoint is to always accompany State agencies to amend and supplement policies and mechanisms if any inadequacies are discovered, rather than waiting until the end of the implementation period.
Therefore, based on the reflections and proposals of the departments, the National Assembly Delegation will receive, study and make recommendations to the National Assembly and the National Assembly Standing Committee to promptly resolve the shortcomings, problems and difficulties arising in practice.
