Proposal to add family allowance to prevent one-time insurance withdrawal

The Social Committee proposed to study additional family allowances, such as tuition support and free vaccinations for workers' children, to limit them from withdrawing social insurance (SI) at one time.

Examining the draft revised Law on Social Insurance, the National Assembly's Social Affairs Committee proposed that the drafting agency, the Ministry of Labor, War Invalids and Social Affairs, consider the allowance regime for children of employees who are paying social insurance.

Supplementing the subsidy can help workers reduce the immediate difficulties of giving birth and raising children; keeping them in the social security system instead of withdrawing it all at once. This is also the opinion of the Standing Committee of the Foreign Affairs Committee and the Culture and Education Committee of the National Assembly.

Regarding voluntary social insurance, the Social Committee proposed that the Ministry of Labor, War Invalids and Social Affairs design short-term, flexible packages so that workers have more options to participate and benefit. Because people in this area currently only have two regimes: retirement and death, in the near future, a maternity allowance of 2 million VND may be added.

The drafting agency needs to further study international experience on child allowances for children of voluntary social insurance participants, such as discounted or free vaccinations, tuition support, and schooling costs for children going to school.

Previously, when commenting on the revised bill, many experts recommended that the management agency add child or family allowance policies to the social security system to expand coverage. For families with children going to school or dependents such as elderly parents, some countries have policies to exempt tuition fees for children, in exchange for workers participating in social insurance. For example, China provides money to elderly parents so that their children can pay social insurance.

After nearly 30 years of implementation, the social insurance policy has so far covered more than 17 million workers, accounting for 37% of the working-age workforce. Statistics for the period 2016-2022 show that nearly 4.85 million people have left the social security system. Of these, 1.3 million people have returned, continued to work and pay social insurance; nearly 3.55 million have not returned; 907,000 workers have withdrawn twice; more than 61,000 people have withdrawn three times.

In the draft revised Social Insurance Law submitted to the National Assembly in July, the Ministry of Labor, War Invalids and Social Affairs proposed two options for one-time social insurance settlement.

Option 1, one-time withdrawal of social insurance, is resolved for two groups of workers. Group 1 is those who participated before the amended Social Insurance Law took effect (expected July 1, 2025), after 12 months of unemployment, if they have a need, they will receive one-time social insurance. Group 2 is those who start working and participate in the system after July 1, 2025 will not receive one-time social insurance, except in cases as prescribed.

Option 2: Employees who have paid social insurance for less than 20 years and after 12 months of unemployment are not subject to mandatory payment and do not participate in voluntary social insurance, can withdraw their benefits in one lump sum if requested. The maximum benefit settlement is not more than 50% of the total time contributed to the Pension Fund for Survivors, the remaining amount is reserved for benefits after meeting the conditions.

The revised Social Insurance Law Project is expected to be discussed by the National Assembly at the October 2023 session, approved at the May 2024 session, and take effect from July 1, 2025.
