Kinhtedothi - On March 26, continuing the 7th Conference of full-time National Assembly deputies, term XV, National Assembly deputies discussed the Draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality.


There is a mechanism to support businesses in tracing the origin.

Speaking at the conference, National Assembly delegate Nguyen Thi Thu Nguyet (National Assembly Delegation of Dak Lak province) said that the Draft Law stipulates that inspection is a technical activity following a certain process to evaluate and determine the suitability of products and goods with the requirements specified in the corresponding technical regulations, including initial inspection, periodic inspection and irregular inspection.

"To effectively implement this content in practice, it is necessary to add a section assigning the Government to specifically regulate the above forms of inspection. Without specific regulations, it will be very difficult to implement, because it is necessary to explain what is initial inspection, periodic inspection, regular inspection and whether the inspection regulations of this law are different from the inspection regulations of specialized laws or related laws or not?" - delegate Nguyen Thi Thu Nguyet wondered.

Concerned about the mechanisms and policies to support businesses in tracing origins, National Assembly delegate Nguyen Tran Phuong Tran (Ho Chi Minh City National Assembly Delegation) suggested that the Drafting Committee consider mechanisms to support businesses in tracing origins from domestic to international to ensure compliance with the requirements of the international market and tracing origins. This is necessary, and needs to be considered and supported to be included in the Draft Law.

According to the delegate, some unsafe products such as boilers and steam boilers are not included in the list of group 2 goods and these products have encountered dangerous incidents during operation. Therefore, the delegate proposed to add these unsafe products to the list of group 2 goods in Clause 1, Article 1 and Clause 4, Article 3 of the Draft Law.

Regarding the regulations on declaration of conformity, some opinions suggested that the Drafting Committee study and thoroughly consider the necessity to ensure current practical requirements; supplement and adjust appropriately to the nature and requirements and create favorable conditions for businesses as well as producers to perform tasks in the process of implementing product development strategies and bringing products and goods to market.

Meanwhile, National Assembly delegate Nguyen Minh Tam (National Assembly delegation of Quang Binh province) said that the provisions in Clause 6, Article 47 of the Draft Law do not include the decision to handle administrative violations, but stipulate internal handling during the operation of the agency inspecting the quality of products and goods. Therefore, the delegate requested to clarify the scope and content of regulation of Clause 6, Article 47 of the Draft Law.

Ensuring international trade, creating conditions for domestic production

Speaking to clarify some issues of concern to National Assembly deputies, Deputy Minister of Science and Technology Le Xuan Dinh said that the Draft Law was created to meet the requirements of Vietnam joining the WTO and TPP; ensuring international trade, protecting and facilitating domestic production. At the same time, it is also a condition to establish technical barriers, balance interests, ensure harmony between national and ethnic interests and the interests of enterprises...

The promulgation of the Law also aims to institutionalize the Party's policy in the spirit of Resolution 57-NQ/TW on breakthroughs in science and technology development, innovation and national digital transformation; and to institutionalize Directive No. 38 of the Secretariat on promoting national quality measurement standards until 2030 and the following years.

Accordingly, the Law amending and supplementing a number of articles of the Law on Product and Goods Quality has added a policy on comprehensive digital transformation in state management of product quality in the digital environment to ensure publicity, transparency, and synchronization...

Regarding the cost of enterprises for products and goods when declaring conformity to standards and regulations, Deputy Minister of Science and Technology Le Xuan Dinh said that this content is directly related to the list of products and goods in group 2. Currently, according to regulations, the list of goods in group 2 is regulated by specialized ministries and this list of goods in group 2 will determine how many or how many items enterprises must strictly manage in terms of quality.

Group 2 goods according to new regulations, new approach, if at low risk level, enterprises can self-declare their conformity. Currently, according to digital transformation approach, enterprises can proactively do it themselves right in the digital environment and after the enterprise fills in all the information fields about the conformity declaration, it helps to eliminate this administrative procedure and reduce costs.

In addition, for group 2 products and goods, when issuing national technical regulations, ministries and branches must conduct impact assessment. This impact assessment must have the participation of people, businesses, associations, especially affected businesses.

Regarding the policy on product and goods quality management, especially group 2 goods, which is an extremely important policy in the current period, Deputy Minister of Science and Technology Le Xuan Dinh said that it is necessary to find a balance between ensuring openness for businesses but ensuring safety and that group 2 goods must be controlled and supervised, but must be controlled and supervised in the digital environment to ensure publicity, transparency and ensure supervision by people and businesses.

Concluding the discussion, Vice Chairman of the National Assembly Le Minh Hoan requested the Ministry of Science and Technology to closely coordinate with the agency in charge of the review to continue reviewing and absorbing the opinions of National Assembly deputies to perfect the Draft Law.

Emphasizing that this is a Law related to the private economic sector and there are many approaches, the Vice Chairman of the National Assembly requested that the process of revision, acceptance and completion must closely follow the goals and requirements set out on the basis of innovation in law-making thinking. At the same time, research must be completed to ensure the feasibility and effectiveness of regulations on product quality management, standards, and identification of group 2 goods.
