Open and transparent auction

According to the plan, in 2023, Thanh Hoa province will organize auctions of at least 50 mineral mines, with reserves of about 50 million m3 of fill soil, 30 million m3 of rock, and 2 million m3 of sand. From the beginning of the year, the Department of Natural Resources and Environment has proactively advised the Provincial People's Committee on the auction of mineral mines; at the same time, actively coordinated with relevant units to implement the auction. Up to now, 5 auctions have been successfully organized for 36 mineral mines. The average auctioned mines increased by 10% or more compared to the starting price, contributing to increasing the State budget revenue.

Thanh Hoa Provincial People's Committee also posted and publicly posted on information portals and newspapers, clearly stipulating the subjects eligible to participate in the auction, including: Organizations, individuals and business households registered to do business in the mineral exploitation industry according to the provisions of law, have paid the auction participation fee, paid the deposit and are not prohibited from participating in the auction according to the provisions of Decree No. 22/2012/ND-CP dated March 26, 2012, the Law on Property Auction 2016 and the Auction Regulations of Thanh Hoa Property Auction Service Center.

Auction participants must fully meet the conditions prescribed in Decision No. 3029/2017/QD-UBND dated August 17, 2017 of Thanh Hoa Provincial People's Committee; Approved plan for auction of sand mining rights; Auction regulations of Thanh Hoa Property Auction Service Center and related legal documents.

Thanh Hoa province has organized many auctions of mineral exploitation rights in a public, transparent and successful manner.

Typically, in the last two times, Thanh Hoa province successfully auctioned the right to exploit minerals in the 4th and 5th rounds, including 6 stone mines, 9 soil mines and 2 sand mines. Notably, Rang Dong Company Limited won the auction of the sand mine in Muong Ly - Trung Ly commune, Muong Lat district with the price of R = 226.6%. Hiep Phat Cam Thuy Joint Stock Company won the auction of the soil mine in Cam Tu commune, Cam Thuy district with the price of 6,116,116,000 VND. Hiep Chung Dung Construction Investment and Trading Joint Stock Company won the auction of the limestone mine in Thanh Ky commune, Nhu Thanh district (mine area of ​​13.924 ha) with the price of 18,999,000,000 VND. Nhat Long Construction Investment Joint Stock Company won the auction of the limestone mine in Yen Lam town, Yen Dinh district (mine area of ​​15.06 ha) with the price of 74,622,316,000 VND. The auction form is public, transparent, successful, and supported by the majority of people and businesses.

Strengthening management

One of the solutions to effectively manage and use minerals, increasing the State budget revenue is to apply the organization of mineral exploitation rights auctions. The application of the auction form has significantly reduced the "ask - give" mechanism, which has many shortcomings and negative aspects, creating conditions for units to confidently invest in long-term production.

According to some businesses: When applying the form of auctioning mining rights, businesses, organizations and individuals participating in the auction are carefully screened, only when qualified can they participate in the auction, that is, if they want to exploit minerals, they must prove their financial capacity (through auction); mining experience and commitment to modern mining and processing technology, ensuring environmental protection... This means that there is no more "land" for businesses that "catch thieves with bare hands" or do business opportunistically.

Recently, Chairman of Thanh Hoa Provincial People's Committee Do Minh Tuan agreed with the proposal of the Director of the Department of Natural Resources and Environment to pilot the auction of a number of mineral mines in the province in the form of online auction. The Chairman of the Provincial People's Committee assigned the Department of Natural Resources and Environment, according to its assigned functions, tasks and authority, to urgently review and select 5 mines to conduct online auctions. The 5 mines selected for online auctions must be similar to the 5 mines that will be auctioned by indirect voting.

In recent times, Thanh Hoa province has focused on strengthening the management of the auction of mineral exploitation rights for common construction materials, focusing on accelerating the progress of granting mining licenses through auctions, especially for minerals used as common construction materials, while meeting the demand for construction materials for key projects.

In addition to serving civil construction projects, some mines also collect blocks of stone for paving stones. The mines are used as filling materials and collect accompanying minerals. Mining activities at the mines meet the demand for filling materials for construction projects and important projects in the province.

To strengthen management, Thanh Hoa province has requested relevant departments, branches and sectors to review and inspect the organization of mineral exploitation rights auctions, especially minerals used as common construction materials, showing unusual signs, with auction results many times higher than the starting price, and handle according to their authority violations of legal regulations on mineral exploitation rights auctions, promptly detect shortcomings in legal regulations to advise and propose competent authorities to amend, adjust and supplement, prevent profiteering, and strictly handle acts of taking advantage of auctions to disrupt the market; propose solutions to limit negative impacts.

According to the leader of Thanh Hoa Department of Natural Resources and Environment: "Regarding post-auction implementation, immediately after the Provincial People's Committee approved the auction results, the Department of Natural Resources and Environment provided specific instructions to the winning enterprises to take the next steps to complete the exploitation dossier as soon as possible. The Department always monitors and provides specific instructions to facilitate enterprises to complete the dossier as soon as possible."
