The draft Law on Teachers includes the following contents: "Do not publicly disclose information about teachers' violations when there is no official conclusion from a competent authority during the process of considering discipline or prosecuting legal responsibility."

According to the Ministry of Education and Training, during the process of collecting public opinions, there were still concerns about the above regulation because it was thought that this content would be entangled with regulations on information, speech and defending teachers.

Regarding this issue, the Ministry of Education and Training explained that the above regulation is necessary to increase the protection of teachers, especially in the context of strong development of social networks and online media as it is today. If teachers commit violations, they will be punished according to regulations.

The characteristics of teachers' professional activities are special. If there is no plan to protect teachers, the affected subjects will not only be teachers but also students.

Protect the honor and reputation of teachers

Regarding this issue, Dr. Lawyer Dang Van Cuong, Head of the Chinh Phap Law Office (Hanoi) said that the regulation of not disclosing information about teachers' violations when there is no official conclusion is consistent with protecting personal privacy, protecting the honor, dignity and reputation of teachers and in accordance with general principles of law.

According to the provisions of the Constitution and laws of Vietnam, everyone is protected by law in terms of honor, dignity, reputation, personal rights, image rights and protection of personal privacy.

According to the law, all citizens have the right to denounce and report violations by organizations and individuals. However, not all cases are correct, and the content of the denunciation is not well-founded. Especially information that has not been initially verified, information posted one-sidedly on social networks.

“The content of the denunciation has not been verified and resolved by the authorities, and has not yet had a final result, but is freely posted on social networks or made public in the mass media, which may violate personal privacy, affect personal rights, image rights and honor and dignity of citizens, including teachers,” said Lawyer Cuong.

According to the lawyer, in fact, over the years, there have been many cases where unverified negative images and information of educational institutions and teachers have been arbitrarily posted on social networks. The incident has caused the recipients of the information to make negative, even malicious comments, seriously affecting the psychology and health of teachers. When the information is incomplete, creating negative public opinion can also negatively affect the process of resolving the incident, especially negatively affecting the psychology of those involved.

"The law also stipulates that information verifying reports from investigative agencies and inspection information that has not yet reached a conclusion is confidential information and cannot be published to protect state secrets and personal privacy," said Dr. Lawyer Dang Van Cuong.

Therefore, the regulation of not disclosing information about teachers' violations without an official conclusion from a competent authority is consistent with the Constitution and laws, including the Law on Protection of State Secrets, the Civil Code, the Law on Cyber ​​Security, the Law on Complaints, the Law on Denunciations and related legal documents. Teaching is a noble profession, a profession respected by the whole society. Teachers' violations of discipline and the law are isolated cases, and a few cases should not affect the reputation of an entire profession.

In addition, Lawyer Dang Van Cuong also said that protecting the reputation, honor, and dignity of teachers is protecting the honor, dignity, and reputation of teachers, which is in line with the Vietnamese tradition of respecting teachers and valuing education. The regulation of not disclosing information about teachers' violations until there is an official conclusion is not tolerating violations but to protect confidentiality during the verification process. When the information is unclear and the violations have not been concluded by a competent authority, protecting that information is appropriate and necessary.

Society and law require teachers to be exemplary models, to have a sense of respect for the law, to respect professional ethics, so if teachers violate discipline, violate the law, violate ethics, they must be responsible before the law, before the final conclusion has legal effect, they need to be protected, that is also to protect the reputation of the industry.

And when there is an official conclusion, it is determined that there is a violation, then teachers as well as all citizens, to whatever extent the violation is committed, will be handled according to the provisions of the law.
