On the morning of February 7, continuing the 42nd Session, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Law on Teachers.

Reporting at the meeting, Chairman of the Committee on Culture and Education Nguyen Dac Vinh said that in order to remove limitations and shortcomings in the management and operation of enterprises belonging to higher education institutions, the agency in charge of the review and the agency in charge of the drafting agreed to propose adding the right of teachers to participate in the management and operation of enterprises established by higher education institutions operating in the fields of scientific development, application and technology transfer. At the same time, review and amend the provisions of relevant laws in the transitional provisions.

In addition, regarding the authority to recruit teachers, the draft Law is adjusted in the direction that, for public educational institutions that are granted autonomy, the head of the educational institution shall carry out the recruitment and be responsible for his/her decisions. For public educational institutions that have not been granted autonomy, the competent authority managing the educational institution shall carry out the recruitment of teachers or decentralize it to the educational management agency, the head of the educational institution shall carry out the recruitment. The educational management agency shall preside over advising the competent authority managing the educational institution to carry out or preside over advising on the decentralization of recruitment; non-public educational institutions shall autonomously carry out recruitment according to their own regulations on organization and operation (Clause 2, Article 14).

According to Chairman Nguyen Dac Vinh, such adjustment affirms the role and responsibility of the education management agency in advising; ensuring consistency with the provisions of the Law on Organization of Local Government, the Law on Civil Servants and the Labor Code.

Regarding salary and benefits policies for teachers, the draft Law has been revised to remove the specific provision on increasing 1 salary level in the administrative career salary scale system for teachers recruited and paid for the first time. Teachers' salaries are ranked highest in the administrative career salary scale system; improving salary policies for civil servants and public employees needs to be studied and calculated synchronously in the process of building salary policies according to job positions.

Regarding the policy of supporting collective accommodation and renting public housing for teachers, teachers are entitled to the policy of renting public housing according to the provisions of the Housing Law or are guaranteed collective accommodation when working in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions. At the same time, supplement the regulation that in case collective accommodation or public housing cannot be arranged, teachers are supported with housing rental according to the level of support for renting public housing; remove the criterion of "meeting all essential conditions" in the regulations on collective housing for teachers.

Agree on proposal to allow preschool teachers to retire early

At the meeting, opinions in the National Assembly Standing Committee basically agreed that, up to now, in general, the contents of the draft Law on Teachers have been absorbed and edited in detail, ensuring adherence to the spirit of innovative thinking in legislative work, only regulating general and principled contents, contents under the authority of the National Assembly, and whose stability has been proven in practice.

Through discussion, opinions basically agreed on the assignment of authority to the education sector to be proactive in recruiting, using, managing, and developing teachers to meet the requirements on quantity, structure, and quality of the teaching staff; assigning the Government to specify the state management responsibilities of each relevant ministry and sector, especially the assignment of state management authority on teachers in localities to the People's Committees at the provincial level for teachers under the management authority of the locality, in which the role of the education sector in leading and advising in performing the state management function on teachers in the locality according to regulations was clearly stipulated.

Regarding the rights and obligations of teachers, the members of the National Assembly Standing Committee basically support the permission for teachers to participate in the management and operation of enterprises established by higher education institutions operating in the fields of scientific development, application and technology transfer; believing that such regulations are appropriate and revolutionary. However, it is recommended that when designing this content, it is necessary to review to ensure compatibility with relevant laws such as the Law on Public Employees, the Law on Enterprises, the Law on Anti-Corruption, etc.

In addition, the National Assembly Standing Committee also agreed with the regulation that teachers' salaries are ranked highest in the administrative career salary system and are entitled to preferential allowances; a mechanism to support house rent for teachers working in difficult areas; a policy of early retirement without reducing the pension rate for preschool teachers who have paid social insurance for 20 years or more...

In her concluding remarks, emphasizing that the draft Law on Teachers is a project of law that is receiving much attention from the public, Vice Chairwoman of the National Assembly Nguyen Thi Thanh requested that the agency in charge of the review continue to closely coordinate with the agencies, maximally absorb the opinions at the meeting, and ensure that the contents of the Explanation Report are presented concisely, without reiterating what has been agreed upon, but focusing on the contents that need to be explained to create high consensus.

In particular, the Vice Chairman of the National Assembly noted that in the process of completing the draft Law, it is necessary to pay attention to updating regulations, ensuring the consistency and synchronization of this Law project with relevant Laws being amended such as: Law on Promulgation of Legal Documents, Law on Government Organization, Law on Organization of Local Government before reporting and submitting to the National Assembly at the upcoming 9th Session.
