Mini apartments will be granted pink books

The management agency will tighten the investment in the construction of mini apartments, while this type of housing will be considered for granting certificates (pink books) according to land law, and can be sold or rented.

These are the new points in the Housing Law (amended), which was voted through by the National Assembly this morning (November 27) with 85.6% of delegates in favor. This law takes effect from January 1, 2025.

Before the National Assembly voted and presented the report explaining and accepting, Chairman of the Law Committee Hoang Thanh Tung said that there were opinions from delegates saying that the regulations in Article 57 on the development of multi-storey houses with many apartments of individuals for sale, lease-purchase, and rent (mini apartments) were too strict and difficult to implement.

These opinions propose regulations in the direction of the State managing and controlling according to planning, granting construction permits, ensuring environmental sanitation, fire prevention and fighting, or the law only stipulates principles and assigns the Government to stipulate details.

The National Assembly Standing Committee believes that the recent development of mini apartments in many localities has been lax, with violations not being handled promptly. This has led to consequences of fire and explosion risks, as well as overloading the urban infrastructure system. In fact, there have been a number of serious fires, causing loss of life and property.

To overcome the shortcomings, after receiving comments, Article 57 of the delegates proposed regulations to tighten management on investment and construction of mini apartments, but still has provisions to ensure the demand and supply of housing for low-income people.

Specifically, individuals who want to build mini apartments (houses with 2 floors or more, each floor has apartments, or 2 floors and a scale of 20 apartments or more) for sale or rent will have to meet the conditions to be the investor of a housing construction project. Apartments that are eligible for a certificate under the land law (pink book) will be sold, rented, or leased under the provisions of the Housing Law and the Law on Real Estate Business.

In addition, investing in mini apartments for rent must meet construction requirements issued by the Minister of Construction. The building must meet fire prevention and fighting requirements as prescribed by law.

The Provincial People's Committee is authorized to regulate traffic routes and ensure that firefighting equipment can extinguish fires at mini-apartments. Management and operation of mini-apartments must comply with the regulations on management and use of apartment buildings issued by the Minister of Construction.

Also according to the Housing Law (amended), the Vietnam General Confederation of Labor is the managing agency of social housing investment projects for workers and laborers to rent.

The National Assembly Standing Committee believes that this regulation will promote the role and responsibility of this unit in caring for and ensuring social security. This also aims to ensure the right to housing, improve the quality of life and attract workers to participate in trade unions.

To have resources for implementation, the new law stipulates that the capital for implementing social housing projects of the Vietnam General Confederation of Labor is taken from the trade union's financial resources, and the project investor must comply with public investment regulations. That is, the management and implementation of social housing investment projects will be carried out by the management unit under the Vietnam General Confederation of Labor in accordance with public investment regulations.

According to the Ministry of Construction, in the first half of this year, the country completed 307 social housing projects in urban areas with 157,000 units; 418 projects with 432,000 units are being implemented.

The Government aims to have at least one million social housing units by 2030, of which 428,000 units will be completed by 2025; the total expected capital is VND849,000 billion, mainly from socialized capital.
