Ministry of Construction guides on housing confirmation to buy apartments over 18 million/m2

People whose names are in the red book but the book does not have assets attached to the land (assets are houses) but only have a certificate of land use rights for agricultural land or residential land, how to confirm housing conditions to be able to buy social housing?

Specifically, according to citizens' feedback, when making a file to register to buy social housing, the certificate of land use rights and ownership of assets attached to the land (red book) but the book does not have assets attached to the land (property is housing) but only has a certificate of land use rights for agricultural land or residential land.

Therefore, the competent authority does not confirm Form No. 02 - Documents proving housing conditions for the reason: Clause 1, Article 29 stipulates: "Not named in the certificate of land use rights and ownership of assets attached to land".

Form No. 02 issued under Circular No. 05/2024/TT-BXD also contains the following content: "Not named in the certificate of land use rights and ownership of assets attached to land". If confirmed, it is not in accordance with the provisions of Decree No. 100/2024/ND-CP; Circular No. 05/2024/TT-BXD.

Responding to this issue, the Ministry of Construction cited Point a Clause 1 and Point a Clause 2 Article 8 of the 2023 Housing Law stipulating the subjects and conditions for owning houses in Vietnam and said: Subjects eligible to own houses in Vietnam include domestic organizations and individuals.

Regarding the conditions for owning houses in Vietnam, domestic organizations and individuals are allowed to own houses through the form of investment in construction, purchase, hire-purchase, receiving gifts, receiving inheritance, receiving capital contributions, receiving house exchanges; receiving houses for resettlement according to the provisions of law; other forms according to the provisions of law...

At the same time, Clause 1 and Clause 3, Article 9 of the 2023 Housing Law stipulate on recognition of housing ownership rights, stating: Organizations and individuals who meet the conditions and have legal housing as prescribed in Article 8 of this Law shall have their housing ownership rights recognized by competent state agencies through the issuance of Certificates of land use rights, house ownership rights and other assets attached to land, except for cases where housing is public property.

Housing whose ownership is recorded in the red book must be an existing house. The order and procedures for granting the book to the house owner are carried out in accordance with the provisions of the law on land.

The competent authority issuing the red book must clearly state in the certificate the type of housing and the level of housing according to the provisions of this Law and the law on construction; in case the housing is an apartment, it must clearly state the construction floor area and the usable area of ​​the apartment; in case the housing is built according to a project, it must correctly state the name of the housing construction investment project approved by the competent authority or the investment policy decision.

Clause 1, Article 29 of Decree No. 100/2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing stipulates issues on housing conditions.

Specifically: The case of not having a house of one's own is determined when the subject specified in Clause 1, Article 77 of the Housing Law and the subject's spouse (if any) do not have their names in the red book in the province or centrally-run city where the social housing project is located at the time of submitting the application to purchase or lease-purchase social housing.

Within 7 days from the date of receiving the request for confirmation of the name in the red book, the Office/Branch of the district-level land registration office of the province or centrally-run city where the social housing project is located shall carry out the confirmation for the case specified in this Clause.

In addition, Article 8 of Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law stipulates the form of documents proving income conditions to be eligible to buy or rent-purchase social housing.

According to regulations, the form of documents proving income conditions for purchasing or leasing social housing is implemented according to Form No. 04 (for subjects specified in Clause 5, Clause 6, Clause 7 and Clause 8, Article 76 of the Housing Law) or Form No. 05 (for subjects specified in Clause 5, Article 76 of the Housing Law but without a labor contract) in Appendix I issued with this Circular.

In case the applicant for purchase or lease-purchase of social housing is married, his or her spouse must also declare a form of documents proving income conditions according to Form No. 04 or Form No. 05 in Appendix I issued with this Circular...

The Ministry of Construction recommends that citizens study the above regulations.

Hanoi: Do not allow land encroachment or illegal construction in industrial clusters

Chairman of the City People's Committee Tran Sy Thanh signed and issued Official Dispatch No. 806/UBND-KT dated March 8, 2025 on strengthening compliance with legal regulations on investment, construction, and land of industrial clusters in the city.

Accordingly, in order to proactively implement the policies of the Party Central Committee and the direction of the City Party Committee; strengthen the leadership and direction of the implementation of political tasks of the Departments, branches and localities in the management of industrial clusters in the city regularly and continuously, the City People's Committee requests the People's Committees of districts, towns and cities to focus on leading and directing the work of establishing, approving/adjusting detailed construction plans at a scale of 1/500, managing construction order, not allowing the situation of taking advantage of the time to carry out acts of land encroachment, illegal construction...

Continue to urge and direct the implementation of site clearance, land allocation and land leasing; speed up the progress of construction and development of industrial clusters. Regularly inspect, monitor, guide and urge the implementation of legal regulations on management and development of industrial clusters, comply with legal regulations on construction order; use land for the right purpose and protect the environment; strictly handle violations.

The Chairman of the People's Committee of the district, town or city shall be fully responsible to the Chairman of the City People's Committee and before the law if there are violations in the State management of industrial clusters in the area.

The Department of Industry and Trade is the focal agency to preside over and coordinate with departments and branches to strengthen supervision, monitoring, and guidance for People's Committees of districts, towns, and investors to strictly comply with legal regulations on planning (especially support service land), investment, land, construction order, environment, etc.; promote investment attraction in industrial clusters and craft village industrial clusters that have completed technical infrastructure construction, ensuring the correct subjects, planning, land use functions, etc. in accordance with regulations.

The Departments of Finance, Planning - Architecture, Agriculture and Environment, and Construction, based on their assigned functions and tasks, proactively coordinate with the People's Committees of districts, towns, and cities to guide, urge, and support investors in technical infrastructure of industrial clusters to complete administrative procedures, speed up investment progress, and build industrial clusters in accordance with Plan No. 20/KH-UBND dated January 20, 2025 of the City People's Committee.

Hung Yen auction land prices continue to increase

The Hung Yen real estate market was bustling with land auctions at the beginning of the year. Specifically, on March 5, the People's Committee of Dan Tien Commune (Khoai Chau District) coordinated with Vietnam Auction Joint Stock Company to organize an auction of the right to use 41 land lots.

It is known that the area of ​​these 41 plots ranges from 74-133m2 with starting prices from 25-48 million VND/m2. The auction created great attraction in the market when attracting 1,200 applications and hundreds of people participating in the direct auction, although the deposit amount was quite large, from 380 million VND to more than 1.2 billion VND.

At the end of the auction, all 41 lots were successfully auctioned. The highest winning price was over 158 million VND/m2, the lowest average price was 66 million VND/m2. Both of these winning prices far exceeded the starting price. The State budget collected 388 billion VND after this auction.

Previously, the Hung Yen land auction market also had a very exciting land auction right after the Lunar New Year holiday. Accordingly, on February 9, at the An Thi Town Cultural House, Lac Viet Joint Stock Auction Company organized an auction of 273 land lots in the Northern Residential Area of ​​An Thi Town (Hung Yen). The area of ​​the land lots ranged from 90-295m2, with starting prices from 19.2-31.2 million VND/m2. The auction attracted more than 4,000 customers. All 273 land lots were successfully auctioned with winning prices from 36-120 million VND/m2, far exceeding the starting price. The total winning auction price was 1,503.378 billion VND.

Not stopping there, the Hung Yen land auction market will continue to be bustling with other auctions when Hung Yen will continue to organize land auctions in many other locations in the province. Specifically, on March 9, the Property Auction Service Center under the Hung Yen Department of Justice will organize an auction of the right to use 92 land plots in locations LK01, LK03 to build houses in the planning location in Cam Ninh commune, An Thi district. The land plots have an area of ​​90-172.91m2, starting price of 19-22.8 million VND/m2. Next, on March 11, 68 land plots for people to build houses in the new rural residential area Xuan Dinh, Pham Hong Thai commune (Khoai Chau district) will also be auctioned with a starting price of 20-26 million VND/m2, area ranging from 118-182 m2.

Regarding the phenomenon of land auctions setting high prices, Mr. Nguyen Van Dinh, Chairman of the Vietnam Real Estate Brokers Association, said that this situation continues to show that the market is still thirsty for investment products, although the market supply has increased after the State's moves to remove bottlenecks, it is still not enough to meet the market's investment demand. In addition, this reality also reflects that the expectation of high real estate prices is still very high, so the speculative mentality is still very heavy. Land auctions with sky-high winning prices are likely to become "a daily occurrence", making it increasingly difficult for the majority of the population to access housing.

The Chairman of the Vietnam Real Estate Brokers Association recommends that with the continuous appearance of high-priced land auctions, investors need to keep a cool head, be alert, and not follow the fever or follow the crowd mentality. Alertness helps investors choose products that are suitable for their financial capacity and choose products with guaranteed legal status. According to Mr. Dinh, to limit this fever, it is necessary to untie the knot in housing supply. Measures to "unblock" supply need to be promoted. Market prices will gradually be adjusted to the real value of real estate when supply gradually meets demand.

Nearly 300 hectares of industrial real estate in Thai Nguyen are about to hit the market

The project to invest in construction and business of infrastructure of Song Cong II Industrial Park - Phase 2 with a land use scale of nearly 300 hectares and a total investment capital of nearly 4,000 billion VND was officially started today (March 10).

The project is invested by Viglacera Thai Nguyen Joint Stock Company - a member company of Viglacera Corporation. According to the plan, the project will be completed within 36 months from the date of land handover. Currently, the project investor has completed investment preparation procedures, compensation and site clearance of about 80 hectares and is focusing on accelerating the investment in technical infrastructure construction and leasing to fill in as committed.

Mr. Nguyen Tran Tuan Nghia, Chairman of the Board of Directors of Viglacera Thai Nguyen Joint Stock Company, said that the Song Cong II Industrial Park project - phase 2 was approved by the Prime Minister in March 2024, in the areas of Ba Xuyen commune, Tan Quang commune, Song Cong city.
