ANTD.VN - The Ministry of Finance has just sent a document to the Chairman of the People's Committee of provinces and cities requesting coordination and direction in managing the issuance of electronic invoices for each sale with the business and retail activities of gasoline.
Accordingly, the Ministry of Finance said that, according to the provisions of Point i, Clause 4, Article 9 of Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government: "The time to issue an electronic invoice for the case of selling gasoline at retail stores to customers is the time when the sale of gasoline is completed for each sale.
Sellers must ensure full storage of electronic invoices for the sale of gasoline to non-business individuals and business individuals and ensure that they can be looked up when requested by competent authorities.
However, the Ministry said that, up to now, according to preliminary statistics, only the Vietnam National Petroleum Group and Ho Chi Minh City Petroleum Company Limited have issued electronic invoices after each sale with about 2,700 stores, accounting for about 16% of the total number of retail gasoline stores nationwide.
The remaining businesses and retail stores selling gasoline, although having implemented electronic invoices, have not yet been able to issue electronic invoices for each sale according to the above regulations.
On November 18, 2023, the Prime Minister issued Official Dispatch No. 1123/CD-TTg on strengthening the management and use of electricity invoices and on December 1, 2023, the Prime Minister continued to issue Official Dispatch No. 1284/CD-TTg on strengthening the management and use of electronic invoices for petroleum business and retail activities.
Therefore, the Ministry of Finance requests that the Chairman of the People's Committee of the province or centrally-run city fully and promptly disseminate the viewpoints and awareness of the responsibilities of organizations and individuals in implementing regulations on issuing electronic invoices for each sale at retail gasoline stores, which is one of the mandatory and important tasks that must be performed locally.

At the same time, direct local agencies to closely coordinate with tax authorities to establish interdisciplinary teams to work directly with businesses and retail stores selling gasoline. Thereby, grasp the reality of the implementation of issuing electronic invoices for each sale, the reality of technical infrastructure, the level and response capacity of all local retail stores selling gasoline; work with businesses providing solutions.
From there, advise and propose to the Provincial and City People's Committees synchronous, drastic and effective solutions and measures to promote enterprises and retail stores of petroleum in the area to issue electronic invoices after each sale; detect and strictly handle according to regulations cases of non-implementation or intentional non-implementation.
The Ministry of Finance also requested the People's Committees of provinces and cities to direct the Department of Industry and Trade, market management agencies to coordinate with the provincial police and relevant agencies to closely monitor and inspect the compliance with the provisions of the law on petroleum trading of petroleum business units in the area, especially the provisions on the obligation to implement regulations on electronic invoices and provide electronic invoice data;
Strictly handle violations of regulations on petroleum business conditions; coordinate with tax authorities to inspect, monitor and handle violations of the law on electronic invoices for each sale of petroleum business units according to the provisions of law.
The People's Committees of the provinces are also requested to direct local authorities to promptly grasp new forms of fraud regarding electronic invoices in general and electronic invoices for petroleum business in particular with the aim of making illegal profits or appropriating State tax money in order to have timely solutions to prevent and handle them according to regulations.
“Issuing electronic invoices for each sale of gasoline will help strengthen control over invoice issuance, revenue management and tax obligations of enterprises, prevent fraud in gasoline trading, limit gasoline smuggling... ensure a fair and transparent business environment, and increase state budget revenue.
To successfully implement this goal, it is necessary to have the drastic participation of the entire local political system, creating consensus in implementation, creating civilized consumption habits, and protecting consumer rights" - the Ministry of Finance stated.
