Ministry of Home Affairs explains disciplinary procedures for commune-level officials

Minister of Home Affairs Pham Thi Thanh Tra has just signed a document to send to the National Assembly Delegation of Vinh Phuc province to respond to voters' petitions sent to the National Assembly before the 7th session.

Voters in Vinh Phuc proposed to study and add a position of commune-level civil servant - Office of the Party Committee to the Law on Cadres and Civil Servants.

Currently, the officer in charge of the Commune Party Committee Office is a non-professional officer at the commune level. In reality, the duties of the officer in charge of the Commune Party Committee Office are numerous, however, the current allowance level is not commensurate.

Specifically, in Resolution 20/2023 of the People's Council of Vinh Phuc province, officials in charge of the Party Committee Office at the commune level are entitled to a monthly allowance/basic salary of 1.6 for communes of type I, 1.5 for communes of type II and 1.3 for communes of type III.

Responding to voters, the Ministry of Home Affairs said that the positions and titles of commune-level cadres and civil servants have been stipulated in Article 61 of the 2008 Law on Cadres and Civil Servants (amended and supplemented in 2019).

At the same time, at point 17.1, clause 17 of Instruction No. 01-HD/TW/2021 of the Secretariat on a number of specific issues implementing the Party Charter, it is stipulated that grassroots party organizations do not establish specialized advisory agencies to assist in work. Party committees assign Party committee members to be in charge of office work, propaganda, organization, inspection, and mass mobilization, all of whom hold concurrent positions.

"The addition of the title of the Commune Party Committee Office as a commune-level civil servant as proposed by voters must be based on the amendment of this Guide and the current Law on Cadres and Civil Servants", the Ministry of Home Affairs informed and will record the proposal to synthesize and submit to the competent authority when the Secretariat has a policy to amend Guideline No. 01-HD/TW.

The Ministry of Home Affairs cited Article 34 of Decree No. 33/2023 of the Government stipulating that the central budget shall implement the allocation of allowance funds (including support for social insurance and health insurance contributions) to make monthly payments to part-time workers at the commune level.

Based on the allowance fund allocated by the central budget to each commune level, the budget source for reforming local salary policies and the characteristics of each commune, the Provincial People's Committee shall submit to the People's Council of the same level for specific regulations on monthly allowance levels for non-professional workers at the commune level in the area.

From there, the Ministry of Home Affairs affirmed that additional support for non-professional workers at the commune level (including officials in charge of the Party Committee Office) is under the authority of the Vinh Phuc Provincial People's Council.

Disciplinary process for commune-level officials

Voters in Lang Son province requested the Ministry of Home Affairs to issue specific instructions on disciplinary procedures for commune-level officials, especially for officials of mass organizations and socio-political organizations at the commune level.

The Ministry of Home Affairs stated that Article 29 of Decree No. 33/2023 of the Government on communal-level cadres, civil servants and non-professional workers at the communal level, in villages and residential groups stipulates that disciplinary action against communal-level cadres and civil servants (including disciplinary procedures) is carried out in accordance with the Government's regulations on disciplinary action against cadres, civil servants and public employees.

"In cases where the law, Party Charter, or socio-political organization has different regulations, the provisions of the law and charter of which the commune-level cadre is a member shall apply," the Ministry of Home Affairs replied to voters.
