What is the basis for determining who is eligible for downsizing?

On the afternoon of February 5, at the regular Government press conference in January, reporters asked about preparations to review and evaluate the number of civil servants and public employees that will be reduced after streamlining the apparatus and the source of support for policies and regimes for civil servants and public employees who retire under the streamlining scheme.

Responding, Mr. Vu Dang Minh, Chief of Office and Spokesperson of the Ministry of Home Affairs, said that on December 31, 2024, the Government issued Decree No. 178/2024 on policies and regimes for cadres, civil servants, public employees and armed forces in implementing the organizational arrangement of the political system.

And just two weeks later, the Ministry of Home Affairs issued Circular 01 guiding the implementation of the Decree; on January 4, the Ministry of Home Affairs advised the Government Steering Committee to issue a document urging and guiding ministries, branches and localities on the regulation of specific criteria and conditions suitable to the characteristics and situation of each ministry, branch and locality.

On that basis, based on the assessment of the last 3 years, choose who to keep for work and who to put on the re-arrangement list to have appropriate calculations.

"The criteria must ensure the principle of clear work, clear people and clear products. If anyone cannot prove what they will do in that position and the annual workload, they will be put on reassignment.

At the same time, we must also calculate how we can find a team with qualities, ethics, qualifications, and professional expertise to be able to operate the new apparatus to ensure efficiency and effectiveness," the Chief of Office of the Ministry of Home Affairs added.

According to the Chief of Office of the Ministry of Home Affairs, this morning (February 5), the Ministry of Home Affairs submitted and received high consensus from the National Assembly Standing Committee on the Government's plans in the project on the Government's structure, personnel structure and the draft Law on Government Organization (amended)... expected to be presented at the extraordinary session for the National Assembly to approve.

Mr. Minh also said that up to now, ministries and localities have had specific plans for restructuring and organizing the apparatus, including very specific numbers.

Regarding human resources, it is necessary to calculate who will be in which position, and we still have to wait until the competent authority, the National Assembly, approves the Government structure.

At that time, the Government will issue a decree on the functions, tasks, and powers of ministries and branches. In addition, ministries that are not subject to reorganization, along with ministries that are subject to mergers and acquisitions, must have a new decree to stipulate their tasks, functions, powers, and organizational structure.

"Ministries that are not subject to restructuring must also be adjusted and reorganized internally to streamline and have a new, effectively operating apparatus.

Therefore, at this time, specifically who is to be retained, who is to be downsized... we must wait until the decision of the National Assembly and the Government is made, and we must listen to their wishes and aspirations to determine the exact number," said Mr. Minh.

There is a formula for calculating the streamlined support level.

Regarding support policies, Mr. Vu Dang Minh said that the Ministry of Home Affairs is working with the Ministry of Finance to develop a circular guiding the funding sources, budget preparation, management and use of funds. Up to now, the Ministry of Finance has consulted with ministries and branches to soon complete and issue this circular.

"This is the basis for the arrangement. In terms of legal basis, there is Decree 178 and circular guiding the method and calculation for each case.

The Ministry of Finance continues to issue circulars guiding the preparation of budget estimates, funding sources, etc. Thus, when the competent authority approves the project, we can operate it immediately," Mr. Minh stated specifically.

Regarding the question "Are there enough financial resources to implement the support?", the representative of the Ministry of Home Affairs said that when drafting Decree 178, the Ministry of Home Affairs asked for opinions from the Central Steering Committee and directly asked for opinions from the General Secretary on this content.

The Deputy Minister of Home Affairs affirmed that in assessing the impact of the implementation of the streamlining and reorganization, the funding source for paying those who will retire after the streamlining and reorganization is lower than the funding source for paying salaries if they continue to work for another 5 years. Thus, there will be enough resources to pay the support costs.

"Regarding the question of who receives high or low funding, it has been clearly regulated and there is a calculation formula in Decree 178 and Circular 01.

Each person will have a different level of funding, depending on the actual salary they are receiving and the number of months off until retirement age. The calculation formula has been created on an Excel table and you only need to enter the number of months to get the funding received," said Deputy Minister Vu Dang Minh.

Regarding the arrangement, the Ministry of Home Affairs has also advised the Central Steering Committee and the Government. Up to now, all documents to be submitted to the National Assembly have been completed and are just waiting for the opening day of the extraordinary session of the National Assembly.
