Is a 5-digit license plate identified as an identification plate?
According to Clauses 1, 2, 3 and 4, Article 39 of Circular 24/2023/TT-BCA, the transitional provisions are as follows:
- For vehicles registered with 5-digit license plates before August 15, 2023 but have not completed the revocation procedure, that license plate number will be determined as the vehicle owner's identification license plate number.
- For vehicles registered with 5-digit license plates, if the vehicle owner has completed the revocation procedure before August 15, 2023, the license plate number will be transferred to the license plate warehouse to issue a new license plate according to regulations.
- Vehicles registered with 5-digit license plates with the symbols "LD", "DA", "MĐ", "R" are still allowed to participate in traffic, even when changing or re-issuing license plates, except in cases where the vehicle owner needs to change the license plate according to the provisions of Circular 24/2023/TT-BCA.
- Vehicles that have been registered with 3 or 4-digit license plates are still allowed to participate in traffic, except in cases where the vehicle owner needs to change to a new identification license plate or when the vehicle owner carries out procedures to issue a new vehicle registration certificate, change the license plate, reissue the vehicle registration certificate, reissue the license plate or register a name change or move the vehicle according to the provisions of Circular 24/2023/TT-BCA, then the 3 or 4-digit license plate will be revoked and changed to a new identification license plate according to the regulations.
- For commune-level police assigned to register motorbikes before August 15, 2023, they will continue to register vehicles according to the provisions of Circular 24/2023/TT-BCA.
Thus, for vehicles registered with 5-digit license plates before August 15, 2023 but have not completed the revocation procedure, that license plate number will be determined as the vehicle owner's identification license plate number.
Vehicle owner's responsibility
According to Article 6 of Circular 24/2023/TT-BCA, the responsibilities of vehicle owners are as follows:
- Comply with the provisions of the law on vehicle registration. Carry out vehicle registration procedures on the public service portal, provide and declare honestly, fully and accurately information on vehicle registration regulations.
Be responsible before the law for the legality of the vehicle and vehicle records. All acts of falsifying records, illegally interfering with the public service portal, vehicle registration and management system to change electronic data information or impact the change of engine number, chassis number of the vehicle for vehicle registration are strictly prohibited.
- Bring the vehicle to the vehicle registration agency specified in Article 4 of Circular 24/2023/TT-BCA for inspection of first-time vehicle registration, vehicle transfer registration, vehicle relocation, renovation, and paint color change;
In case the vehicle registration certificate or license plate is blurred, damaged or lost, the vehicle owner must declare and complete the procedures for issuing a new vehicle registration certificate or license plate (hereinafter referred to as "issuance") or reissuing the vehicle registration certificate or license plate (hereinafter referred to as "reissuance") according to regulations.
- Within 30 days from the date of issuance of the certificate of technical safety and environmental protection for a modified motor vehicle by a competent authority or change of information on the vehicle owner's name or change of head office address or place of residence to another province or centrally-run city or when the vehicle registration certificate expires, the vehicle owner must go to the vehicle registration authority to carry out procedures for reissuance or revocation of the vehicle registration certificate and license plate (hereinafter referred to as revocation procedures) according to regulations.
- When selling, donating, inheriting, exchanging, contributing capital, allocating, or transferring a vehicle (hereinafter referred to as transferring vehicle ownership):
+ The vehicle owner must retain the vehicle registration certificate and license plate (not give it to the organization or individual receiving the vehicle ownership transfer) and submit the vehicle registration certificate and license plate to the vehicle registration authority to carry out the revocation procedure; in case of transferring vehicle ownership with the license plate of the auction-winning vehicle, the vehicle owner must submit the vehicle registration certificate to the vehicle registration authority to carry out the revocation procedure;
+ Within 30 days from the date of completing the vehicle ownership transfer paperwork, the vehicle owner must complete the revocation procedures; in case the above deadline has passed and the vehicle owner fails to complete the revocation procedures or hand over the vehicle registration certificate and license plate to the organization or individual receiving the vehicle ownership transfer to complete the revocation procedures, before handling the case, the vehicle registration authority shall issue a decision to sanction the vehicle owner for not completing the revocation procedures as prescribed;
In case the vehicle owner does not carry out the revocation procedures after transferring vehicle ownership, he/she shall be responsible before the law for any violations related to that vehicle;
+ After the vehicle owner completes the recall procedure, the organization or individual receiving the transfer of ownership completes the vehicle registration procedure according to regulations.
- Within 07 days from the date the vehicle expires, the vehicle is broken and cannot be used, or the vehicle is destroyed due to objective reasons, the vehicle owner must declare on the public service portal and submit the vehicle registration certificate and license plate to the vehicle registration agency or the commune-level police (regardless of the vehicle owner's place of residence) to carry out the recall procedure.
