Ignoring the rights of 191 teachers
In recent days, many teachers in Hoang Hoa district have been upset because they were recruited as civil servants but their salaries were not re-arranged (calculated according to years of compulsory social insurance contributions) according to regulations, causing them to suffer disadvantages.
Circular 05 of the Ministry of Home Affairs on salary arrangement for civil servants has been effective since August 15, 2024, but up to now, many teachers in Hoang Hoa district have not had their salaries rearranged according to regulations.

According to Thanh Nien reporters' research, when recruiting teachers as civil servants, the district-level People's Committee (recruiting unit) must base on Decree 161/2018/ND-CP dated November 29, 2018 of the Government on amending and supplementing a number of regulations on recruiting civil servants and public employees, upgrading civil servant ranks, promoting public employees and implementing the regime for some types of work in state administrative agencies and public service units (effective from January 15, 2019); Circular No. 05 by the Ministry of Home Affairs stipulating standards and conditions for consideration of promotion to grade 2 and grade 1 for administrative officers, clerical officers, and archival officers; salary classification for those recruited and accepted as civil servants (effective from August 15, 2024) and a number of other regulations and instructions to classify salaries for civil servants.
However, Hoang Hoa District "forgot" to rearrange the salaries of teachers recruited as civil servants in the period from 2018 to 2024, with a number of 191 teachers. Not only did Hoang Hoa District "forget" to rearrange the salaries, it also "forgot" to adjust the seniority allowance for many other teachers.
"According to regulations, we are eligible for a higher salary than the current one when we are recruited as civil servants. However, it has been many years since Decree 161 took effect, and more than 6 months since Circular 05 took effect, but the People's Committee of Hoang Hoa District has not yet implemented salary classification based on the years of compulsory social insurance contributions for us.
We have also submitted a petition to the People's Committee of Hoang Hoa District, and even directly asked the District Internal Affairs Department (the unit that advises and carries out salary procedures for civil servants - PV) but still do not know when we will be paid according to regulations," said a teacher in Hoang Hoa District.
Confused about when to calculate salary
Speaking with Thanh Nien reporter, Mr. Nguyen Hung Thao, Head of the Internal Affairs Department of Hoang Hoa District People's Committee, confirmed that the fact that the district has not rearranged the salaries of 191 teachers is true.

Mr. Thao explained that the reason for the delay in rearranging salaries and calculating seniority allowances for teachers is because the regulations do not clearly state whether salaries are calculated from the time teachers are recruited into civil servants or from the time the regulations take effect.
"Because the regulations are not clear, we do not know when the salary for teachers will be calculated. We have compiled and prepared all the documents and the number of teachers. Therefore, we are sending a document to the Department of Home Affairs for comments," said Mr. Thao.
Mr. Thao added that in the near future, when there is guidance from the Department of Home Affairs, if we rearrange salaries and calculate seniority allowances for teachers, we will need nearly 14 billion VND to pay back money to teachers (teachers receive back pay) according to regulations. Therefore, Hoang Hoa district must wait for the province to arrange funds before it can be implemented.
According to Thanh Nien reporters' investigation, many localities in Thanh Hoa province in the period of 2018 - 2024 also recruited teachers as civil servants like Hoang Hoa district, but the localities all based on current regulations to promptly rearrange teachers' salaries, so there was no situation of "forgetting" teachers' rights like in Hoang Hoa district.
On the morning of March 21, speaking with Thanh Nien reporter, Mr. Tran Quoc Huy, Director of Thanh Hoa Department of Home Affairs, said he had not received a report from Hoang Hoa District People's Committee about the above incident.
According to Mr. Huy, in principle, when localities recruit teachers, they must arrange salaries according to regulations to ensure the rights of workers. Mr. Huy also said that up to now, in Thanh Hoa province, there has never been a case of "forgetting" to rearrange salaries for civil servants like in Hoang Hoa district today.
