Many expectations from new regulations of the Bidding Law 2023

DNO - On May 31, in Da Nang, Vietnam Law Newspaper, Law and Development Magazine, and the Bidding Management Department (Ministry of Planning and Investment) co-organized the Workshop "Bidding Law 2023 - Expectations and Challenges for the Construction Investment Sector".

The workshop was chaired by Prof. Dr. Le Hong Hanh, Editor-in-Chief of the Law and Development Magazine; Dr. Vu Hoai Nam, Editor-in-Chief of the Vietnam Law Newspaper; MSc. Vu Quynh Le, Deputy Director of the Bidding Management Department; Dr. Tran Cong Phan, Permanent Vice President and General Secretary of the Vietnam Lawyers Association.

Speaking at the opening of the workshop, Dr. Tran Cong Phan said that bidding is an activity of selecting contractors to effectively implement socio-economic development projects through competition between bidding enterprises on quality, efficiency, progress and many other criteria.

Bidding is a common economic and legal institution worldwide. In Vietnam, bidding activities were first legalized in Chapter VI of the 2003 Construction Law. Subsequently, the 2003 Bidding Law was promulgated to regulate bidding activities to meet the requirements of market economy development and economic integration.

After 10 years of implementation, the 2013 Bidding Law has revealed many shortcomings compared to the country's development, leading to the National Assembly promulgating the 2023 Bidding Law, effective from January 1, 2024.

According to Dr. Tran Cong Phan, the 2023 Bidding Law has many new points and is expected to open many bottlenecks for the rapid and sustainable development of the economy as I emphasized above. However, there are still gaps between the law and law enforcement that legal experts and economic experts call discontinuities.

The 2023 Bidding Law may also have some cuts that can only be recognized through implementation. Although it has only been in effect for more than 5 months, due to its special nature, the 2023 Bidding Law has been applied quite a lot in project implementation, especially construction works.

To fully and comprehensively assess both the theory and practice of the provisions of the Law on Bidding applied in the construction sector, Vietnam Law Newspaper, Law and Development Magazine and the Bidding Department organized the Workshop "Law on Bidding 2023 - Expectations and Challenges in Implementation in the Construction Sector".

The workshop brought together bidding law experts, construction law experts, representatives of construction enterprises and corporations from many localities across the country with the aim of assessing the regulations that legislators expect, the opportunities and challenges for construction enterprises in the application process.

The workshop had presentations with 3 main contents including: new points and expectations of the 2003 Bidding Law; bidding and information technology; challenges that need to be anticipated in the implementation of the 2023 Bidding Law. Thereby, providing relatively complete and useful information, opening up many issues from theory to practice related to the 2023 Bidding Law in the implementation in the construction sector.
