The revised and supplemented contents focus on 6 groups of contents in the policies.
Examining the Draft Law, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy said that the Standing Committee of the Committee basically agrees with the amendment of regulations on conformity assessment activities to meet the requirements of transparency in the implementation of FTAs.
However, the Draft Law needs to study and supplement regulations on operating conditions of conformity assessment organizations to ensure the competitiveness, objectivity and effectiveness of this activity, especially the activities of certifying conformity with standards and regulations...
The Chairman of the National Assembly's Committee on Science, Technology and Environment also proposed to compare with laws recently passed by the National Assembly or draft laws being submitted to the National Assembly for consideration to ensure consistency of the legal system; continue to review and compare with relevant international treaties to which Vietnam is a member to ensure compatibility.
Chairman Le Quang Huy also said that the Standing Committee of the Science, Technology and Environment Committee requested the drafting agency to review and provide specific guidance on the development, appraisal and promulgation of local standards in accordance with reality so that they can be implemented in localities; clearly stipulate the time and order in which ministries and branches must give their opinions when localities have documents proposing the development of standards, limiting the situation of prolonged pushing and shoving that affects local socio-economic development.
Discussing the Draft Law, paying attention to local technical regulations, Head of the Delegation Affairs Committee of the National Assembly Standing Committee Nguyen Thanh Hai said that the promulgation of local technical regulations faces many difficulties related to qualifications, capacity and necessity, so further assessment of this issue is needed.
Ms. Nguyen Thanh Hai said that currently, only Hanoi city has issued local technical standards (Technical standards on planning and architecture in the districts of Ba Dinh, Hoan Kiem, Dong Da, Hai Ba Trung), other provinces and cities have not issued them yet; there are 66 other local standards that have been issued related to products and goods. "Should we only regulate basic local technical standards?", Ms. Nguyen Thanh Hai said.
Chairman of the National Assembly's Economic Committee Vu Hong Thanh said that after 17 years of promulgation, it is necessary to study and review to comprehensively amend the Law on Technical Standards and Regulations, ensuring that it is consistent with the scale of the economy, the actual situation, the current legal system and deep integration, and participation in many new-generation Free Trade Agreements (FTAs).
At the same time, the Chairman of the Economic Committee also reflected that through monitoring, businesses reflected that technical standards somewhere still had inconsistent regulations, unclear understandings leading to problems in the implementation process. For example, standards on fire safety of construction works, or standards on conditions, business investment in trade. In addition, businesses also reflected that the process of issuing regulations and standards was "jerky, too fast, too shocking" without a roadmap for implementation. "Such problems create increased compliance costs for businesses, affecting the pressure on businesses to compete for goods. This is something that needs to be amended to have regulations, avoiding problems and shortcomings" - Chairman Vu Hong Thanh stated.
At the discussion session, the National Assembly Standing Committee also said that it is necessary to study and supplement the responsibilities for developing, appraising, announcing, notifying, and applying national standards; applying simplified procedures and processes, and bases for developing standards and promulgating national technical standards; developing and applying basic standards of state agencies and enterprises; developing, appraising, and promulgating national regulations and local technical regulations, etc.
