Delegate Luu Quang Huy (Soc Son district) questioned that the arrangement of land and housing funds for public purposes such as community centers, medical stations, etc. in inner-city areas is very necessary. On March 10, 2023, the City People's Council issued Resolution 06-NQ/HDND approving the project on effective management, use, and exploitation of public assets of Hanoi City, period 2023 - 2025, orientation to period 2026 - 2030. The City People's Committee issued Decision 2189 dated April 3, 2023 approving the project and Plan 155-KH/UBND dated May 26, 2023 to implement the project.
Accordingly, the Hanoi People's Committee assigned the Department of Construction to implement a number of contents, including the content of presiding over and coordinating with relevant units to review the entire service business area in resettlement and commercial apartments handed over by the investor to the city to arrange for public areas of the city, however, the implementation results are still limited. The delegate asked about the specific results of the implementation of the above assigned tasks.
Responding to delegates, Director of Hanoi Department of Construction Vo Nguyen Phong said that regarding the review of the first floor housing fund, the Department has completed the review of 201 resettlement apartments. Of which, 130 apartments have commercial service areas on the first floor with a total area of 97,042m2 and have leased 43,458m2. Currently, for the remaining area, Hanoi Housing Development Company and the City Housing Management Center are developing a plan to continue the bidding process to auction the right to lease.
As for the area of the first floor of commercial apartments that must be handed over to Hanoi City for management, after review, there are 21 projects with a total area of 55,615m2, of which the organization received 17,587m2. Currently, the review continues to carry out the recovery and handover of about 38,000m2.
Regarding the arrangement for public purposes, out of a total of 201 resettlement apartments, 94 apartments do not have service business areas or community activity houses. Therefore, the implementation of converting service business areas to arrange for community activity houses has been strongly directed by the City and has basically completed this content.
Regarding the arrangement of area for medical stations, the Department has requested the Department of Health and districts to review all needs. Currently, the units are reviewing and synthesizing data on needs, from which the Department of Construction will work with related units to report to the City People's Committee to balance the land fund to serve the arrangement of medical stations on the first floor of resettlement apartment buildings.
Delegate Trinh Xuan Quang (Thanh Xuan district) said that according to the report summarizing the tasks that the Government requested the City to handle and resolve through inspection and examination, there are 2 tasks that the City assigned to the Department of Natural Resources and Environment that are overdue: inspecting and handling violations in granting land use right certificates and granting permits for building houses on agricultural land in some wards of Ha Dong district; reviewing and clarifying some contents of denunciations of violations of land use rights and construction projects in Duong Noi ward, Ha Dong district. The delegate asked the Director of the Department of Natural Resources and Environment to clarify the causes and roadmap for completing the above tasks.
Responding to the question of delegate Trinh Xuan Quang, Director of the Department of Natural Resources and Environment Le Thanh Nam said that the Deputy Prime Minister has issued a document directing and assigning the departments of the city and Ha Dong district to clarify a number of contents according to the content of the accusation of violations of land, construction and project implementation in Duong Noi ward, Ha Dong district with 6 contents.
“All 6 contents need time to be reviewed, considered and specifically handled. Up to this point, the city has resolved 3 contents. Specifically, Ha Dong district has consulted with organizations, individuals and communities related to handling the existing 2 transformer stations and kindergartens; is reviewing and recovering land in planning blocks that have not been recovered for management according to regulations and reviewing violations of self-conversion of agricultural land to non-agricultural land, construction of houses or factories…” - Director of the Department of Natural Resources and Environment stated.
Regarding the issue of inspecting and handling violations in granting land use right certificates and granting permits for housing construction on agricultural land in some wards of Ha Dong district, which was asked by delegates, Director of the Department of Natural Resources and Environment Le Thanh Nam said that these problems mainly related to 5 wards: Phu Luong, Phu Lam, Phu La, Dong Mai and Bien Giang. These are all violations that have occurred for a long time, during the period when the wards merged from Thanh Oai district to Ha Dong district.
The Director of the Department of Natural Resources and Environment pointed out: “At the time of handover, there was a rush and careless issuance, leading to violations. This content has been handled by the Ha Tay Provincial Police (old), however, up to now, some violations have not been completely resolved.”
At the same time, the Department, together with the City Inspectorate and related departments and branches, also inspected, urged and segmented for further handling.
Responding to the question of delegate Nguyen Ngoc Viet (My Duc District Group) about the results of the implementation of the Project to build a comprehensive land records system in the city, Director of the Department of Natural Resources and Environment Le Thanh Nam stated that the industry identified this as a key task to make transparent and simplify administrative procedures for people and businesses in the city and serve the management work of the industry.
From 2018 to now, the City People's Committee has extended the deadline for the Department to complete the Project 3 times. Most recently, the City People's Committee issued a decision approving the project implementation period until the end of 2025. However, the Department strives to operate the Project and the land management database in the city from now until December 31, 2024.
Commit to the City People's Council to complete land tax collection in 2024
At the questioning session, delegate Tran Khanh Hung (Ba Vi district group) stated that according to the report of the Hanoi Tax Department, the amount of tax debt related to land in the past 3 years is 40,848 billion VND, accounting for 50% of the debt receivable in the entire city. In particular, the debt related to land that is still pending and has not been resolved as of December 31, 2023 is 4,025 billion VND, accounting for 26% of the total debt related to land in the city. These are projects with problems, mainly under the authority of departments, branches and sectors, including the responsibility of the Department of Natural Resources and Environment.
According to the delegate, the implementation process of land price calculation has not been timely, affecting the budget revenue, and also negatively affecting the operation of enterprises. For example, through supervision, the project of Hoang Van Thu new urban area (Hoang Mai district) phase 3, the project of Thach Ban Lakeside residential area and some other projects, investors want to fulfill their obligations but have not paid the land fee yet...
From there, the delegate asked the Director of the Department of Natural Resources and Environment to inform how many projects have been allocated land or leased land but have not yet had a decision to determine land use fees and land rents and solutions to overcome this situation.
Responding to this issue, Director of the Department of Natural Resources and Environment Le Thanh Nam said that up to now, there are still about 65 projects that have to calculate land rental fees such as land use fees and one-time land rental fees. In the first 6 months of the year, the Department calculated for 9 projects, collected 4,200 billion VND and has been approved by the city.
Faced with the city's 2024 target being much larger than that of 2023, the Director of the Department of Natural Resources and Environment said that he will regularly coordinate with the financial agency and commit to the City People's Council to complete land tax collection, ensuring the city's budget targets for 2024.
