Kinhtedothi - On the morning of March 10, at the 43rd session, the National Assembly Standing Committee gave opinions on the Draft Law on Railways (amended).

Presenting the review report, Chairman of the Committee for Science, Technology and Environment Le Quang Huy proposed to continue reviewing and selectively refer to international experiences suitable to Vietnam's reality to ensure the feasibility of a number of regulations related to investment, management, and exploitation of railway infrastructure, preferential policies, and support for railway development, ensuring absolute security and safety for the railway system, especially the need for specific and synchronous solutions to resolve outstanding issues in the implementation of current railway projects, ensuring financial and human resources for the implementation of the provisions of the Law.
Discussing at the meeting, paying attention to the prohibited acts in the draft Law, Chairman of the National Assembly Delegation Work Committee Nguyen Thanh Hai said that the act of "Encroaching and occupying the railway traffic safety corridor and the protection area of railway works" is aimed at new works.
"With existing projects such as the "train street coffee street" (located on the border of Dien Bien ward, Ba Dinh district; Cua Nam ward, Hang Bong, Hoan Kiem district) which are very busy with service and tourism businesses, there must be a huge amount of money to relocate households out of the railway safety corridor," the Chairman of the Delegation Work Committee stated the reality.
The Chairwoman of the Delegation Work Committee also cited the reality of the residential area along Giai Phong Street (Hanoi), where houses are close together next to the railway. "The law strictly prohibits encroachment and occupation of railway traffic safety corridors, but for existing structures, I suggest considering funding to create resettlement areas for these households," Ms. Nguyen Thanh Hai raised the issue.
Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung said that compared to the current law, the draft law provides more general regulations on railway activities in general, thus not clarifying specific policies for high-speed railways and urban railways.
"The draft Law stipulates that high-speed railways and urban railways are only technical levels of railways, but has not yet identified specific and particularly prominent types of railways that need focused and key investment," said Mr. Hoang Thanh Tung, who suggested clarifying the scope of the draft Law's regulation for urban railways and high-speed railways.
Also interested in investment in urban railway and high-speed railway projects, Permanent Deputy Chairman of the National Assembly's Economic and Financial Committee Le Quang Manh requested the drafting agency to clarify the concretization of policies stipulated in the draft Law or other relevant laws on the State's policies on railway development and incentives and support in railway operations.
Regarding railway activities, Mr. Le Quang Manh suggested that there should be a specific impact assessment to ensure feasibility and fairness in applying preferential policies.
Speaking at the discussion, National Assembly Chairman Tran Thanh Man said that amending the Railway Law requires stronger decentralization and delegation of power to localities in railway management and ensuring consistency in the current legal system.
The National Assembly Chairman also suggested that the draft Law should focus on strong breakthrough policies to develop the railway system; there should be a separate chapter regulating urban railways and high-speed railways with priority mechanisms on resources, technology and specialized human resource training, learning from international experience, etc.
Concluding the session, Vice Chairman of the National Assembly Le Minh Hoan said that the National Assembly Standing Committee requested the drafting agency to continue to receive and explain opinions at the session, submit to the National Assembly for consideration at the ninth session, and approve at the tenth session.
