Reasons for the need to build new railways

On the afternoon of February 13, the National Assembly listened to the presentation and report on the investment policy for the Lao Cai - Hanoi - Hai Phong railway construction project.

Minister of Transport Tran Hong Minh said that the country is on the path of rapid economic growth and entering a new era, in the context of the outdated railway system after more than 100 years of construction, it is necessary to invest in new railway projects to meet the country's development needs.

According to the proposal, the main railway line is about 390.9 km long and 3 branch lines are about 27.9 km long. Regarding the investment scale, a new electrified railway line with a gauge of 1,435 mm will be built to transport both passengers and goods. The total land use demand is approximately 2,632 hectares, with a resettled population of about 19,136 people.

The Government proposes the investment project in the form of public investment. The preliminary total investment is over 200,000 billion VND (equivalent to about 8.3 billion USD). The capital will be used from the State budget (central, local), domestic capital, foreign capital (borrowed from the Chinese Government) and other legal capital sources.

Regarding implementation progress, the Government proposed to prepare a feasibility study report from 2025, striving to basically complete the project by 2030.

To implement the project, the Government proposed to apply 19 specific policies under the authority of the National Assembly, including 15 policies already applied to the North-South high-speed railway project and 4 new policies.

Need to clarify the types of exempted behavior

Representative of the appraisal agency, Chairman of the Economic Committee Vu Hong Thanh proposed to evaluate the overall effectiveness of the railway projects planned for investment and carefully evaluate the financial plan and impacts during the operation and exploitation of the projects to minimize future risks.

Regarding capital sources, according to Mr. Thanh, the specific and special mechanisms and policies have been allowed to be applied by the National Assembly in the past and have been reviewed and commented on by competent authorities, so the Government's proposal is well-founded. However, it is recommended that during the implementation process, it is necessary to comply with the principle of ensuring macroeconomic balance and national public debt safety.

Notably, regarding specific and special mechanisms and policies, the review agency found that the Government's proposal to the National Assembly to allow the application of a number of specific and special mechanisms and policies is very necessary. However, regarding policies related to the exclusion, exemption or reduction of responsibility for heads of agencies, units, cadres, civil servants and public employees participating in and implementing the project, there are still many opinions.

According to Mr. Thanh, there are opinions that, with the urgent progress of the project, investment preparation may have shortcomings that cannot be assessed; this policy will contribute to protecting responsible cadres, civil servants, and public employees. However, to ensure feasibility in the implementation process, it is necessary to clarify the scope of subjects, types of exempted behaviors, clearly identify factors of unintentional and non-profit errors, and specific responsibilities that are exempted.

In addition, there are other opinions that current laws have provisions on exemption or reduction of responsibility for cadres, civil servants and public employees when performing their duties; regulations on encouraging and protecting cadres who are dynamic, creative, dare to think, dare to do, dare to take responsibility for the common interest.

Although the project was implemented in a short time, the process of completing the project documents has complied with legal procedures. The application of the mechanism may create uneven policies for officials and civil servants who have participated in consulting on similar projects. Therefore, the above policy is unnecessary.
