Regulating land rent differences publicly and transparently

On June 21, according to the working program of the 5th Session, the National Assembly spent the whole day discussing the draft Land Law (amended).

Participating in the speech, delegate Tran Van Khai (Ha Nam delegation) said that one of the tasks set out in Resolution 18 is to perfect the policy mechanism on land finance, research and have a policy to regulate land rent differences, ensuring publicity and transparency.

Mr. Khai said that the land rent difference is formed from the change of land use purpose, from low-value land to high-value land, agricultural land is bought, compensated at low prices and then converted to non-agricultural, commercial and service land with prices ten times higher.

The problem of handling land rent differences for people's land is hiding many injustices in society.

The delegate stated that the Land Law (amended) this time must eliminate injustice from benefits due to land rent differences, avoid loss of land resources, develop land finance policies, methods for determining land prices, and ensure harmony of interests in exploiting land rent differences between the State, investors and people.

To unleash potential, maximize the value of land resources, and resolutely overcome corruption and negativity in land management, delegates said it is necessary to properly resolve two issues of land rent and land price differences.

Regarding the principles of land price determination, delegates said that the provisions in the draft law are not sufficient to determine land prices in real life. The basis for determining land prices close to market prices is still vague.

Delegates suggested that the drafting agency continue to research and perfect methods for determining land prices according to market prices, ensuring clarity and full and comprehensive institutionalization as required by Resolution 18.

A better life has many indicators to evaluate

Commenting on the principles of compensation and resettlement, delegate Nguyen Quang Huan (Binh Duong delegation) said that according to the Government's Submission, section 7.1 explaining Article 90 of the draft Law on principles of compensation and resettlement has removed the content that "people after compensation have the same or better living conditions than before".

The submission explained that the removal of this content was due to many different opinions. According to the delegate, the above explanation is not convincing and does not correctly understand the spirit of Resolution 18.

Resolution 18 clearly stated that the lives of people who receive compensation are equal to or better than before, which does not mean that people must have bigger houses or wider roads to their houses...

There are many indicators to evaluate a better life, one of the methods to evaluate this issue is to interview and record people's opinions.

"If we understand it literally, we will get caught up in compensation work and there will be many conflicting opinions, unable to determine how people will have a better life," the delegate said.

Mr. Huan also said that due to a misunderstanding of this issue, Article 95 stipulates the recovery of agricultural land and then compensation with housing.

It can be seen that the regulations in the new draft only care about specific income and do not care about the lives and livelihoods of affected people.

Therefore, he said that it is necessary to study pilot projects in many places and regions across the country, carefully study Resolution 18 to have a reasonable explanation, gain consensus from voters, and not remove this principle from the content of the compensation price mechanism.

Affirming that land use planning is a particularly important content and is reflected throughout the Land Law, delegate Tran Dinh Gia (Ha Tinh delegation) suggested a thorough assessment to make appropriate adjustments for effective management and use, serving socio-economic development. Land use planning is divided into 3 levels: national level - provincial level - district level.

To facilitate the management of the Central agencies and proactively organize implementation of localities, Mr. Gia suggested that each national and provincial planning level should limit a number of key land groups necessary to ensure national and provincial goals, not specify too much detail about land types, detailed land use indicators from higher levels allocated to lower levels, only allocate according to detailed indicators, not control the total indicators of each land type such as agricultural land, non-agricultural land, unused land.

According to him, land use indicators will be detailed in district-level land use planning and plans. In addition, there needs to be a flexible mechanism in assessing the conformity between land use planning and plans. A land plot can have many purposes of use and many types of land that cannot be clearly identified during the planning process .
