ANTD.VN - By March 31, 2024, petrol retail stores and businesses that do not issue electronic invoices for each sale may be considered for temporary suspension of business operations and have their petrol business licenses and certificates of eligibility revoked.

The General Department of Taxation has just continued to issue an official dispatch requesting the heads of tax departments of provinces and centrally-run cities to resolutely implement the implementation of electronic invoices (E-invoices) for each sale of gasoline and oil retail businesses.

Previously, the General Department of Taxation issued a series of documents directing the Tax Department and assigned the Director of the Tax Department to directly direct local tax authorities to advise the People's Committees of provinces and cities to establish Steering Committees, interdisciplinary working groups and closely coordinate with departments and branches to synchronously and effectively deploy solutions to successfully implement electronic invoices for each sale of gasoline and oil retail business activities in the area.

According to the summary reports of the Tax Departments, by March 6, 2024, only 8,285 retail gasoline stores nationwide had issued electronic invoices for each sale, accounting for about 52.2% of the total number of retail gasoline stores. There are still 30/63 localities with progress of less than 50%, and 17/63 localities with progress of less than 30%.

According to the General Department of Taxation, the Tax Department has not yet effectively advised the People's Committee to direct local agencies and departments to coordinate with tax authorities and establish interdisciplinary inspection teams to conduct inspections and handle cases of non-compliance or intentional non-compliance with regulations.

From there, it leads to the mentality and mindset of petroleum businesses to delay and not implement.

Therefore, the General Department of Taxation requests the Director of the Tax Department, especially localities with a low rate of retail gasoline stores issuing electronic invoices for each sale, to directly and resolutely direct the strict implementation of regulations on electronic invoices, connect data with tax authorities according to the provisions of Decree No. 123/2020/ND-CP and the direction of the Prime Minister; organize the resolute, synchronous and effective implementation of the solutions directed by the Ministry of Finance and the General Department of Taxation.

Tax departments must assign and assign specific targets and tasks to each department and civil servant of the Tax Department to further enhance monitoring capacity and promptly support taxpayers in issuing electronic invoices for each sale at retail stores and businesses selling gasoline in the area.

The General Department of Taxation continues to request tax departments to proactively establish inspection teams or advise the People's Committees of provinces and cities to establish interdisciplinary inspection teams to conduct inspections at retail gasoline stores regarding the implementation of electronic invoices and data connection to tax authorities, and to impose penalties according to law for cases of non-implementation or intentional non-implementation.

Notably, the General Department of Taxation requested that, based on local realities, the tax department proactively advise the People's Committee to direct competent authorities to consider requests to temporarily suspend business operations and revoke licenses and certificates of eligibility for petroleum business according to the provisions of law for petroleum retail stores and petroleum businesses that do not comply with the provisions on electronic invoices in the Law on Tax Administration and Decree No. 123/2020/ND-CP by the end of March 31, 2024.
