Hoang Mai District delays site clearance for Tam Trinh Street until April 2025

According to the Steering Committee for Compensation and Site Clearance of Hoang Mai District (Hanoi), the completion date for the site clearance work for the Tam Trinh Road expansion project has been postponed to April 2025.

Thus, the site clearance work of this project has changed the completion time 4 times: September 30, 2024; December 31, 2024; March 31, 2025 and now April 30, 2025. Thus, compared to the original plan, the project is at least 7 months behind schedule and if the City does not quickly take action, the project will have difficulty "finishing" in February 2026 as planned.

Problems arise

Currently, the difficulties that the Hoang Mai district government is facing are the large amount of land acquisition, when the total land acquisition area (after adjusting the boundary) is over 54,000m2, involving about 1,590 households and 20 organizations, in the area of ​​3 wards Mai Dong, Hoang Van Thu and Yen So. On average, each ward must conduct 40 to 50 dialogues with people to verify and complete procedures according to the law.

Next, many policies related to compensation and site clearance are beyond the decision of the People's Council and People's Committee of Hoang Mai district and need to be reported and consulted with departments and the People's Committee of Hanoi City when applying the 2024 Land Law.

Accordingly, the 2024 Land Law stipulates that the resettlement housing fund must be prepared before issuing decisions to reclaim land from households. Currently, the resettlement housing fund serving Tam Trinh Street is the CT1, CT2, CT3 buildings of Den Lu Urban Area, which have been degraded when they were requisitioned to serve Covid-19 patients and need to be renovated and repaired to be eligible for handover. Hoang Mai District must ask the City for approval to provide funding for resettled households renting houses during the renovation of Den Lu Urban Area.

Director of the Hoang Mai District Land Fund Development Center Vu Tuan Dat said that according to the previous Land Law and the City's documents on site clearance, illegal constructions (not permitted by competent authorities for construction) are supported by a percentage of the construction price of new constructions (depending on the time of construction). However, the 2024 Land Law does not have any regulations on this content, which means that households that build illegal constructions will not be compensated.

In fact, on Tam Trinh Street, most of the residential buildings were built without a construction permit or without a document from the competent authority.

Applying the new law, the People's Committee of Hoang Mai district has no basis to apply compensation or support policies, prolonging compensation work, even though the ward authorities continuously organize dialogues with the people.

Delay GPMB progress by 30 days

Hoang Mai District People's Committee has sent a written report to the City and the City leaders have assigned departments and branches to consult on the guidance document. After receiving guidance from the City on these two important contents, Hoang Mai District will have the basis to continue implementing compensation and support work, draft a plan to submit to the Compensation and Resettlement Support Council for approval as well as issue land recovery decisions, striving to basically complete the site clearance work in April 2025.

Director of Hoang Mai District Land Fund Development Center Vu Tuan Dat said that the Center has reported these difficulties and problems in writing to the Standing Committee of Hoang Mai District Party Committee, the District People's Committee, and the District Compensation and Site Clearance Steering Committee.

"If the City has a written instruction before March 20, 2025, within 30-35 days, we will complete the site clearance work for the Tam Trinh road project. Currently, all the price preparation work has been completed by the staff of the District Land Fund Development Center, we are just waiting for the City's decision to compensate the people" - Director of the Hoang Mai District Land Fund Development Center said.

The actual records of the reporter show that, in the sections that have been cleared, the contractor has completed the final base layer (mixture layer) and cannot deploy the Asphalt concrete layer because some electric poles are still within the construction roadway. Up to now, after 8 months of construction, the construction output value of the contractor of Truong Son 97 Branch has only reached about 15 - 18% of the construction contract value (over 294 billion VND), significantly behind schedule.

Recently, the Standing Committee of Hoang Mai District Party Committee has decided to postpone the completion date of the handover of the Tam Trinh road project by 30 days, ending before April 30, 2025. Thus, this is the fourth time that Hoang Mai district has had to postpone the completion date of site clearance, despite the great efforts of the relevant units.

According to Chairman of Hoang Mai District People's Committee Nguyen Minh Tam, the district government pays special attention to this project, because this is one of the key projects that has lasted for many years. During the implementation process, there are many transitional policies due to the application of the 2024 Land Law, so many problems arise that need to be resolved by the City.

Completing the site clearance progress of this project in April will help promote the progress of other projects in Hoang Mai district. According to the plan approved by the City in 2025, Hoang Mai district will implement 116 projects with a total area of ​​over 356 hectares, being one of the districts with the largest number of projects and land use area in the City.
