Ministry of Defense proposes to stop production activities at Cam Ranh port in case of national defense situation

The Ministry of National Defense proposed to stop production and business activities at Cam Ranh International Port (Khanh Hoa) when there is a defense situation and large-scale exercises.

Cam Ranh base is a class A military zone.

The Ministry of National Defense drafted the Prime Minister's decision on amending the regulations on management of Cam Ranh international port operations and widely solicited opinions from organizations and individuals on this issue.

The Ministry of National Defense said that on June 27, 2016, the Prime Minister signed Decision No. 25 on promulgating regulations on management of Cam Ranh international port operations, which were amended once on October 3, 2019.

However, the Law on Management and Protection of National Defense Works and Military Zones and detailed regulations and implementation instructions have taken effect since January 1, 2025, which identifies Cam Ranh military base as a type A military zone, a special group that must apply especially strict management and protection measures to ensure absolute secrecy and safety.

Accordingly, the basic content of the draft focuses on amending and supplementing a number of provisions that are no longer consistent with practice and legal regulations in the process of applying the regulations on management of operations of Cam Ranh International Port - Ministry of National Defense issued with Decision No. 25/2016/QD-TTg, amended and supplemented in Decision No. 29/2019/QD-TTg.

Specifically, the Ministry of National Defense proposed to amend the regulations on the name of Tan Cang - Petro Cam Ranh Limited Liability Company (abbreviated as Tan Cang - Petro Cam Ranh Company).

This is an enterprise that performs defense tasks and combines economic and social development, with 100% capital from enterprises in which the state holds 100% of the charter capital (instead of Saigon Newport Corporation holding 75%, Vietnam Oil and Gas Group holding 25% of the charter capital).

Temporarily suspend production and business activities in case of national defense situation

According to the Ministry of National Defense's proposed amendments and supplements to responsibilities and powers, the Ministry of National Defense decided to temporarily suspend production and business activities of Cam Ranh International Port to carry out defense tasks.

The reason given by the Ministry of National Defense when proposing this issue is that when Cam Ranh International Port performs defense tasks (especially when there are defense situations and large-scale exercises...) it may have to stop all production and business activities at the port, causing the implementation of signed contracts to be delayed or canceled, causing economic damage of great value (including both direct and indirect consequences).

During the negotiation and signing of economic contracts, Tan Cang - Petro Cam Ranh Company proactively included cases of stopping production and business activities to serve national defense activities in the force majeure clause to avoid losses.

However, in case of disputes, there must still be a written confirmation or decision from a competent authority as a basis for carrying out legal procedures. Therefore, according to the Ministry of National Defense, adding this clause is necessary.

During the implementation process, Tan Cang - Petro Cam Ranh Company will proactively propose to competent authorities to issue documents to temporarily suspend production and business activities of Cam Ranh International Port to properly perform national defense tasks, while avoiding economic losses for the state and the company.

In addition, the Ministry of National Defense also sought opinions to supplement and amend a number of contents on financial guarantees for defense activities at Cam Ranh International Port; foreign military ships arriving and departing from the port; Vietnamese people and vehicles entering and leaving the port; services and activities carried out in the port area, etc.
