Draft Law on Teachers stipulates an increase of one salary level in the salary scale system of the professional administration for teachers who are recruited and have their salaries adjusted for the first time.
On the morning of February 7, continuing the 42nd session, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Law on Teachers.
Presenting the report, Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh said that after receiving and revising, the draft Law consists of 9 chapters and 46 articles, 4 articles less than the draft submitted at the 8th Session.
Regarding the salary and benefits policy for teachers (Article 25), Mr. Nguyen Dac Vinh said that some opinions agreed with the regulation of increasing 1 salary level in the administrative career salary scale system for teachers recruited and receiving salary for the first time.
However, there are still concerns and disagreements with this regulation and a request to assess the impact of the policy in general relation to the team of cadres, civil servants and public employees of the political system.

" Incorporating the opinions of National Assembly deputies, the draft Law is revised in the direction of removing the specific regulation on increasing 1 salary level in the administrative career salary scale system for teachers recruited and receiving salary for the first time.
Teachers' salaries are ranked highest in the administrative career salary scale system; improving salary policies for civil servants and public employees needs to be researched and calculated synchronously in the process of building salary policies according to job positions ," said Mr. Nguyen Dac Vinh.
Regarding the policy of supporting collective housing and renting public housing for teachers (Article 26), the Chairman of the Committee for Culture, Education and Information suggested implementing regulations on the policy of renting public housing for teachers according to the provisions of the Housing Law to ensure the consistency of the legal system.
There is a proposal to add a policy to support teachers' housing rent when they work in difficult areas according to regulations.
Taking into account the opinions of National Assembly deputies, the draft Law has been revised. Accordingly, teachers are entitled to the policy of renting public housing according to the provisions of the Housing Law or are guaranteed collective accommodation when working in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions.
At the same time, supplement the regulation that in case collective accommodation or public housing cannot be arranged, teachers will be supported with housing rent according to the level of support for renting public housing; remove the criterion of "meeting all essential conditions" in the regulation on collective housing for teachers.
Regarding the policy of early retirement for preschool teachers (Article 28), many opinions agree with the policy of early retirement according to the law for preschool teachers; it is proposed to add the criterion that teachers must have paid social insurance for 20 years or more to be eligible for early retirement and not have their pension rate deducted.
But there are also concerns about the resources to ensure the implementation of this policy and that the principle of contribution and benefit must be ensured according to the Law on Social Insurance.
The Standing Committee of the Committee believes that allowing preschool teachers to retire earlier than the age prescribed by law is a policy built on the characteristics of the profession and suitable for the characteristics of preschool learners.
" Incorporating the opinions of National Assembly deputies, the draft Law amends and supplements the regulation that teachers in preschools, if they wish, can retire at an age lower than the retirement age of employees under normal conditions, but not more than 5 years, and the percentage of pension benefits due to early retirement will not be reduced if they have paid social insurance for 20 years or more ," said Mr. Nguyen Dac Vinh.
Regarding the retirement regime at an older age for teachers (Article 29), there are opinions suggesting specific regulations on requirements and conditions for teachers to extend their retirement age; there are opinions concerned about extending the working time for teachers at preschool and general education levels.
The Standing Committee of the Committee believes that it is necessary and reasonable to stipulate that teachers with high qualifications, academic titles, and degrees, and teachers working in specific specialized fields and sectors can have their working time extended and retire at an older age in order to take advantage of and exploit high-quality human resources; to overcome the shortage of highly qualified teachers in a number of specific specialized fields and sectors that the country's development trend requires.
The draft Law also clearly stipulates the conditions for implementing this policy when educational institutions have a need, teachers are healthy enough and voluntarily extend their working hours; at the same time, it adds the criterion of "meeting the standards and conditions of educational institutions".
Also according to the Chairman of the Committee on Culture and Education, during the period of extended retirement age, teachers in public educational institutions shall not hold leadership or management positions and shall not be allowed to retain leadership or management position allowances.
In the Government's explanatory report submitted to the National Assembly Standing Committee at the 38th session, there was an assessment of the regulation that teachers who are recruited and have their salaries increased by 1 salary level in the administrative career salary scale system for the first time.
According to local reports, as of May, the number of teachers recruited in the 2023-2024 school year was 19,474. Of which, 5,592 were preschoolers, 7,737 were primary schoolers, 4,609 were junior high schoolers, and 1,536 were high schoolers.
If the policy of increasing salary by 1 level in the administrative career salary scale system is implemented, the State budget will need to add about 22 billion VND/month to pay teachers' salaries, which means the annual budget will need to add 264 billion VND.
