Previously, on July 27, Lam Dong Provincial People's Committee decided to approve the starting price for organizing the auction for leasing assets on land and annual land lease payment for Thuy Ta restaurant at land plot No. 04, cadastral map No. 14, Ward 1, Da Lat City.
The Provincial People's Committee assigns the Department of Finance to be responsible for the process, documents, and procedures for determining the starting price and the conformity of the starting price with the market price at the time of appraisal. The Department of Natural Resources and Environment advises the Provincial People's Committee to issue a Land Lease Decision as a basis for signing a land lease contract in accordance with the provisions of the Land Law.
The People's Committee of Da Lat City selects an auction organization to organize the auction of the right to lease assets as prescribed in Article 11 of Decision No. 01/2019/QD-UBND dated February 14, 2019 of the Provincial People's Committee on promulgating regulations on leasing houses and villas owned by the State in Lam Dong province; submit to the Provincial People's Committee for approval of the auction results and sign a property lease contract with the auction winner according to regulations.
The Provincial People's Committee requires agencies, organizations and individuals participating in the auction to meet the conditions specified in Clause 3, Article 1 of Decree 10/2023/ND-CP dated April 3, 2023 of the Government on amending and supplementing a number of articles of the Decrees guiding the implementation of the Land Law. Within 30 days from the date of signing the asset lease contract, pay the full amount to the agency assigned to organize the asset auction.
In case the full auction winning amount has not been paid within the prescribed time limit, the property buyer must pay a late payment fee according to the provisions of the law on tax administration.
In case of violation of prohibited acts in Clause 5, Article 9 of the Law on Property Auction and other relevant legal provisions, the property auction results will be canceled, compensation for damages will be paid and handling will be carried out according to the provisions of the Law on Property Auction and current legal provisions.
At the same time, it is necessary to comply with the lease term, purpose of use, architectural planning, and payment method as prescribed in Decision No. 697/QD-UBND dated April 4, 2023 of the Provincial People's Committee on auctioning assets on land and annual land lease payments for Thuy Ta restaurant.
